A RESOLUTION OF THE CITY COUNCIL OF T�IE CITY OF REDDING
DECLARING HANGAR AND GROUND SPACE PROPERTY LQCATED
AT REDDING MUNICIPAL AIRPORT AS EXEMPT SURPLUS
PROPERTY AND AUTHQRIZING THE CITY MANAGER, QR
DESIGNEE, TO 1�TEGOTIATE THE TERMS OF THE LEASE{S) OF SAID
PROPERTY AND EXECUTE ANY OTHER DOCUMENTS NECESSARY
TO EXECUTE LEASE(S) WITH C'URRENT AND FUTURE TENANTS
WHEIZEAS,the City of Redding awns property located at the Redding Municipal Airport,
described in Exhibit A, excepting parcels labeled as 22, 23, 24, 25, 30, and 32, attached and
incorporated herein; and
WHEREAS,the City af Redding has determined that there is a need ta utilize the property
described in Exhibit A(hereafter, the"Property"} for non-public purpases, such as private aireraft
and equipment storage and aviation education; and
VVHEREAS, the Surplus Property Act (California Government Cade section 54220 et
seq.) pravides guidelines for �acalities to follow regarding the sale and lease of City-awned
property, and
WHEREAS, Government Code sectifln 54221(b) requires that a local agency shall, at a
regular public meeting, deelare land as either "surplus land" ar "exempt surplus land" befare it
may take any action to dispose of the land; and
�HEREAS, Government Code section 54221(f}(1}(G) provides that surplus land that is
subject to valid legal restrictions that are not impased by the local ageney and that wQuld make
housing prohibited, unless there is a feasible method tQ satisfactorily mitigate ar avoid the
prohibition on the site, can be classified as exempt surplus property; and
WIIEREAS, the Property is subject to valid legal restrietions imposed by federal law that
would prohibit the residential use of the Property; and
WHEREAS,per the Federal Register Volume $1,No. 115,Rules and Regulatians:Policy
on the Non-Aeronautical Use of Airport �Iangars airport operators that have accepted federal
grants may use airpart praperty only for aviation-related purposes; and
WHEREAS, when an airport operatar accepts Airpart Impravement Program grants or �

other FAA-administered financial assistance,eaeh sueh airpQrt operator must agree to comply with
federal grant assurances; and �
WHEREAS Grant Assurance 19 O eration and t�azntenance �

spansor from causing or permitting any activity that would interfere with use of airport praperty
for airport purpases; and

WIIEREAS, the Praperty is subject to a11 FAA grant assurances, and, as a consequence,
the Property the use of the Praperty is restricted ta aviatiQn uses only; and
W�-IEREAS, residential use of the Praperty would vialate the aforementioned grant
assurance because such use is not for aviation purpases; and
W�IEREAS, the United States of America conveyed the Property to the City of Redding
by Instrument af Transfer dated October 7, 194'7, attached and incorparated herein as Exhibit B,
and that said Instrument af Transfer provides that the Property shall be used solely far "public
airpart purposes;" and
Vt'HEREAS, due to aperatiQn of federallaw and the aforementioned deed restriction, the
PrQperty therefore qualifies as "exempt surplus" Zand within the meaning of Government Cade
section 54221(f}(1)(G);
NOW, THEREFORE, THE CITY Ct}UNCIL OF THE CITY OF REDDING DOES
HEREBY RESQLVE THAT:
1. The abave recitals are true, correct, and are adopted herein as findings of faet.
2. The Property is declared exempt surplus property, and shali hereafter be availabie for sale
and lease subject to compliance with all federal grant assurances and the retention of any
easement(s), if required, for public service purposes.
3. Sale and/or lease of the Property by the City is eategorically exempt from the requirements
of the California Environmental Q�a�ity Act {CEQA) pursuant to Section 15312 af the
CEQA Guidelines (Surplus Government Property Sa1es),
4. Sa1e andJor lease of the Property by the City is exempt fram the requirements of CEQA
pursuant to Section 15061 (Common Sense Exemption) because the Property has no
environmental attributes and, as a result, it ean be seen with certainty that there is no
possibility that the sale ar lease of the Pra�er�y and development of the same far aviation
supportive uses wi11 have a significant effect on the environment.
5. The City Manager shall, pursuant to State of California Housing and Community
Development("HCD") Surplus Land Act Guidelines Section 4Q0{e},provide a copy of this
resolution to the State af California Housing and Community Development Department at
least thirty days prior to disposition of the Property.
6. The City Manager shall have authority to negotiate and, upon satisfaction of HCD
Guideline Section 4Q0{e}, execute any lease(s) with current and future tenants for hangar
andlor ground spaee for aviatian related uses.
