HomeMy WebLinkAboutReso 2021-142 - Authorizing The Application And Adopting The Amended PLHA Plan For The Permanent Local Housing Allocation Program RESOLUTION NO. 2021-142 A RES�LUTION OF THE CITY COUNCIL tJF THE CiTY OF REDDING AUTHORIZING TIIE APPLICATION AND AD4PTING THE AMENDED PLHA PLAN F4R THE PERMANENT LOCAL HflUSING ALLOCATIt�N PRC}GRAM AND AUTHORIZING THE CITY MANAGER QR DESIGNEE TO APPLY, ACCEPT, AMEND, AS NEEDED AND IMPLEMENT THE PERMANENT L4CAL HOUSING ALLOCATION GRANT FOR THE FIVE-YEAR GRANT TERM A necessary quorum and majority of the Council Members of City af Redding ("Applicant") hereby consents to, adopts and ratifies the following Resolution� A. WI�EREAS, the Department is authorized to provide up to $304 million under the SB 2 Permanent Local Hausing A1location Program Farmula Component fram the Building Homes and Jobs Trust Fund fflr assistance ta Cities and Counties(as described in Health and Safety Cade secti�n 50470 et seq. (Chapter 364, Statutes of 2017 {SB 2)); and B. WHEREAS,the State of California(the"State"},Department of Housing and Community Develapment ("Department") issued a Notice of Funding Availability ("NOFA"} dated February 26, 2020, under the Perinanent Local �-Iousing A1location (PLI�A) Program; and G WHEREAS,Applicant is an eligible Lacal government wha h�as applied far program funds to administer one or mare eligible activities flr a local �r Regional Housing Trust Fund to whom an eligible Local government delegated its PLHA fQrmula allocation; and D. WHEREAS,the Department may approve funding allacations for PLI-�A Program,subject to the terms and conditions of the Guidelines,NOFA, Program requirements, the Standard Agreement and other contracts between the Department and PLHA grant recipients; and E. WHEREAS, an June 16, 202Q, the City Council adc�pted a resolution autharizing the City Manager ar designee to submit a grant application far the PLHA program of which occurred on July 24, 2020; and F. WHEREAS, a Notice of Public Hearing was published in a newspaper of general circulation on July 31, 202Q, wherein the public was natified of the PLHA plan and its opportunity to comment on the plan through the cic�se of the Public Hearing dated August 18, 2020; and G. WHEREAS, the T�epartment subsequently approved the Applicant's PLHA plan and executed the Standard Agreement fln June 16, 2021; and �I. WHEREAS, Applicant now desires to amend the PLI-�A plan, as such a Notice of Public Hearing was published in a newspaper of general circulation an December 10, 2021, wherein the public was notified of the amended PLHA plan and its opportunity ta comment on the plan through the close of Public Hearing dated December 21, 2021; NOW THEREFORE BE IT RESOLVED THAT: 1. If the City of Redding receives a grant of PLHA funds fram the Department pursuant ta the above referenced PLHA NOFA, it represents, and certifies, that it will use a11 such funds in a manner consistent and in compliance with all applicable state and federal statutes, rules, regulations, and laws, including, without limitation, all rules and laws regarding the PLHA Program, as we�1 as any and all cflntracts Applicant may have with the Department. 2. City of Redding is hereby authorized and directed to receive a PLHA grant, in anamount nat to exceed the five-year estimate of the PLHA formula allocatians,as stated in Appendix C af the current N(3FA $2,020,8$4 in accardance with all applicable rules and laws. 3. City of Redding hereby agrees to use the PLHA funds for eligible activiti�s as approved by the Department and in aecordance with all Pragram requirements, Guidelines, other rules and laws, as well as in a manner consistent and in compliance with the Standard Agreement and other contracts between the City of Redding and the Department. 4. The City Couneil of the City of Redding eertif es that the City of Redding shal� submit an applicatian on its behalf and administer the PLHA grant award for the formula allocation of PLHA funds,pursuant to Guidelines Section 304(e) and 300(d), and the legally binding agreement between the recipient of the PL�-IA funds and the Applicant is submitted with the PLHA applicatifln. 5. The City Council of the City of Redding certifies that it has or may subgrant same or al1 of its PLHA funds to another entity or entities. Pursuant to Guidelines Section 302{c}(3), "entity" means a housing developer or program operator, but does not mean an administering Laea1 government to whom a Local government may delegate its PLI-�A allocation. 6. The City Council of the City of Redding certifies that its selectian process of these subgrantees was or will be accessible to the public and avoided or sha�1 avoid any conflicts of interest. 7. Pursuant to the City Council af the City of Redding's eertification in this Resolution, the PLHA funds will be expended only for eligible Activities and consistent with a11 program requirements. 8. The City Cauncil af the City of Redding certifies that, if funds are used for the acquisition, construction or rehabilitation of for-sale housing projects or units within for-sale hausing prajeets, the grantee shall record a deed restriction against the property that will ensure compliance with one of the requirements stated in Guidelines SectiQn 302(c){6)(A),{B)and (C}. 9. The City Cauneil of the City of Redding certifies that,if funds are used for the development of an Affordable Rental Housing Development, the Loca1 government shall make PLHA assistance in the form of a 1ow-interest, deferred loan to the Sponsor of the Projeet, and such loan sha�1 be evidenced through a Promissory Note secured by a Deed of Trust and a Regulatory Agreement shall restriet occupancy and rents in aeeordance with a Loca1 government-approved underwriting of the Project for a term of at least 55 years. 10. City of Redding sha11 be subj ect to the terms and conditions as specified in the Standard Agreement, the PLHA Program Guidelines and any other applicable SB 2 Guidelines published by the Department. 11. The City Manager, or his designee islare authorized to execute the PLIIA Program Application, the PLHA Standard Agreement and any subsequent amendments or rriodificatians thereto, aswell as any Qther doeuments which are related to the Program or the PLHA grant awarded to Applicant, as the Department may deem appropriate.
