SUMMARILY VACATING TI�E CITY'S INTEREST IN A PORTION OF MARK

OF ALTA SUBDIVISIQN, BOOK 5 OF MAPS AT PAGE 53, SHASTA COUNTY

WHEREAS:
A. The 60-foat-wide portian of Mark Street being cansidered for summary vacation was acquired by
implied dedieation with the recordation of the Map af A1ta Subdivision filed in Book 5 of Maps at
Page 53, Shasta Caunty Records and is deseribed in Exhibit"A"and shown on Exhibit`B"attached
and made a part hereof by referenee.
B. This portion of Mark Street has not been used for the purpose of which it was dedicated and may
be determined to be eXcess. The adjacent parcel awner has asked that the City vacate this portion
as described in Exhibit "A" and shown hatched on Exhibit"B" attached and made a party hereof
by reference.
C. The Ciry is RETAINING 15-foot-wide public service easements as deseribed in Exhibit"A" and
shown an Exhibit"B."

NOW, THEREFORE, THE CITY COUNCIL DETERMINEB, RESOLVES, AND ORDERS AS �
Ft3LLOWS: �

1, The City Councii elects to proceed in this matter under the provisions of the California Streets and �
Highways Code, Section 8300 etseq. s
�
2. Pursuant to Streets and Highways Code 8334, the City Council determines this partion of Mark �
Street to be excess as is unnecessary for present or prospective public street use.
3, The City Councii approves the request to summarily vacate this portion of�11�Iark Street South of
Geary and adjacent to Black 10 as shown on the Map of ALTA Subdivision as deseribed in Exhibit
"A"and shown hatched on Exhibit`B."
4, The City reserves and excepts from this vacation, a 15-foot-wide public service easement for the
purpose of erecting, installing, constructing, removing, repairing, replacing, reconstructing,
maintaining and using for public-serviee purposes any and a11 materials, fixtures, applianees,
equipment, pipes pipelines, wires, and cables necessary far the transmission , distribution, and
delivery af eleetrieity, water, sewer, storm water, gas, cable television, communieation, and
information service utitities over, along, upon, under, and across t11e parcel Qf real property
deseribed in Exhibit"A"and shown on Exhibit"B."
3. The vacation of this portion of Mark Street is cansistent with the General Plan and qualifies as
Categarically Exempt from environment review under the California Environmental Quality Act
Guidelines Section 15461. Mark Street was acquired by dedication to the City for street purposes.
There are no environmental attributes ta the praperty underlying the street which wauld merit
preparation of a mitigated negative decIaration ar enviranmental impact repart. The underlying
property does not have significant values for wildlife habitat or other environmental purposes and
is of such size and shape that is incapabie of independent development or use. As such,there is no
pc�ssibility that vacation of the street will have a signi�eant impact an the environment.
4. The City Cierk is directed to cause a certified copy af this Resolution of Vacation, attested by the
Clerk under seai,to be reearded in the Offiee of the Shasta County Assessor/Reoorder.

BEGINNI(UG at a point distant South 2�38' East, 60.00 feet from an iran pipe marking the
Southeast corner af Lot 3 of Block 4 of the Alta Subdivision, as shown on the map recorded
April 29, 1939 in Book 5 of Maps at Page 53 in the office of the County Recorder of said Shasta
County; thence Southerly along the Westerly line c�f Mark Street, on a curve to the eight,
tangent ta previous bearing, having a radius of 297.10 feet, through a central angie of
