City Council, Special Meeting

The meeting was called to order by Mayor Anderson with the following Council Members
present: Kight, Pohlmeyer, and McGeorge. Council Member Cibula was absent.
Also present were City Manager Warren, City Attorney Wingate, Deputy City Manager
Starman, Fire Chief Wagner, Administrative Services Director Bachman, Deputy Fire Chief
Gunsauls, and City Clerk Strohmayer.
ACQUISITION OF PROPERTY ON CHURN CREEK ROAD FOR POTENTIAL FIRE
STATION

City Manager Warren provided an overview of the Report to City Council dated September
29, 1999, relating to a foreclosure sale bid of 3.75 acres located at 111 Churn Creek Road
to be held on Monday, October 4, 1999. Mr. Warren advised that this is an ideal location for
an additional fire station in the northeast section of the city, and better suited for a quicker
response time than the two designated potential sites located on Oasis Road and Palacio
Drive. He related that the total owed on the property is $126,098, and actual out-of-pocket
expenses total about $70,000, of which payment on $50,000 may be deferred for up to two
years.
Mr. Warren stated that although there has been discussion of constructing and manning a fire
station in the area, at this time no recommendation is being made as to when this can be
accomplished. Assuming, however, that another fire station will eventually be built in the
northeast area, he urged the City Council to capitalize on the unique opportunity to acquire
this strategically located property. Mr. Warren indicated that staff believes the cost to the
City for a fire station is less than the value of the property.
Mr. Warren related that after he became aware that Community Development Block Grant
(CDBG)funds cannot be used to acquire the property, he would propose that it be financed
through the general fund budget with reimbursement to this fund when one or both of the
Oasis Road and Palacio Drive properties are sold. He recommended that the Oasis Road
property not be sold, however, until the construction of a fire station commences.
City Manager Warren recommended that the City Attorney be authorized to submit a credit
bid at the foreclosure sale for the Churn Creek Road property designated for a future fire
station site.
In response to Council Member Pohlmeyer, City Attorney Wingate advised against exceeding
the minimum bid by more than $20,000. He said that should another party purchase the
property for the full amount, the City would benefit by receiving $50,000 in penalty fees,
which can be used to offset other delinquent assessment districts.
Fire Chief Wagner emphasized that a computerized geographic fire station location study
showed the Churn Creek Road property to be practically on the spot where a fire station in
this region should be located. He added that the Oasis Road and Palacio Drive sites were
secured without the benefit of such a study.

MOTION: Made by Council Member Kight, seconded by Council Member McGeorge,
authorizing the City Attorney to submit a bid at the foreclosure sale to purchase the 3.75 acre
parcel located at 111 Churn Creek Road for a future fire station site; that the bidding limit
be left to the City Attorney's discretion; and that staff return to the City Council for financing
options. The Vote: Unanimous Ayes

There being no further business, at the hour of 4:12 p.m., Mayor Anderson declared the
meeting adjourned.
