Adjourned Regular Meeting

The meeting was called to order by Mayor Kehoe with the following Council
Members present: P. Anderson, R. Anderson, McGeorge, Murray and Kehoe.
Also present were City Manager Warren, Police Chief Blankenship, City Clerk
Strohmayer.
ASSEMBLY BILL 399

City Manager Warren provided a brief overview of the Report to City Council dated
January 5, 1996, incorporated herein by reference, regarding the Peace Officers
Research Association's (PORAC) request for the City to adopt a resolution
supporting an override of a veto of Assembly Bill 399 (AB399). He explained that
AB399 would have required that local public agencies that contract with the
Public Employees Retirement System (PERS) for retirement benefit services to
increase retirement benefits to surviving spouses of deceased members who
subsequently remarry. The Bill would also require local public agencies to
provide additional health benefit coverage to surviving spouses and dependents
of peace officers killed in the line of duty.
It is the recommendation of staff that the City Council not support the override
of the veto; rather recommend that the City Council wait and see what the new
legislation includes.
At the direction of the City Council and the Assistant City Manager, Police Chief
Blankenship stated he contacted the Lobbyist and Executive Director of the
California Peace Officers Association (CPOA) and the Governor's Liaison to Law
Enforcement. He related that the Governor favored AB399 Is concept, however, felt
a rewrite was necessary. He noted that new legislation is currently being
written and should have the support of the legislature. He stated that the
Governor has also requested PORAC assistance in writing the new legislation. He
indicated that a copy of the new legislation is not available.
MOTION: Made by Council Member R. Anderson, seconded by Council Member Murray,
to not support the override of the veto of AB399, but rather wait and see what
the new legislation includes. The Vote: Unanimous Ayes
ADJOURNMENT
There being no further business, at the hour of 5:05 p.m., Mayor Kehoe declared
the meeting adjourned.
