RESOLUTION MAKING FINDING THAT WATER SYSTEM PROJECT
IS NECESSARY AS A HEALTH MEASURE

� HUNTINGTON DRIVE/DEBBIE LANE WATER ASSESSMENT DISTRICT
N0. 1987-3
The City Council of the City of Redding hereby finds ,
determines and resolves as follows :
1 . The City Council hereby finds and determines the
following:
a. Attached hereto as Exhibit A, and by this
reference incorporated herein, is a memorandum dated September 4,
1986 , from Dr . Stephen J. Plank, Shasta County Health Officer ,
recommending to the Shasta County Board of Supervisors that the
Board of Supervisors make a determination that a public health
hazard exists within the prescribed area along Debbie Lane and
Huntington Drive in the unincorporated territory at the southeast
border of the City of Redding, and further recommending that an
appropriate proceedings be commenced to connect residences within
that area to the City of Redding water system as the appropriate
response to the health hazard.
b. Attached hereto as Exhibit B , and by this
reference incorporated herein, is a form of notice to the Churn
Creek Bottom residences on Debbie Lane and Huntington Drive, which
notice bears no date, which notice is signed by both James C. Pedri ,
Engineer for the State of California Regional Water Quality Control

indicates that contamination of indeterminate origin poses a threat

to the quality of drinking water from private wells in the subject
area, enumerates factors thought to contribute to the pattern of
i contamination, and recommends connection to an existing public water
system as essential to assure health protection in the subject area.
c. Attached hereto as Exhibit C, and by this
reference incorporated herein, is a copy of the summary of minutes
of the meeting of September 16, 1986, of the Shasta County Board of
Supervisors , confirming that on said date, the Board of Supervisors
by motion duly made, seconded and carried, concurred in the findings
of a public health hazard in the subject area, and authorized the
City of Redding to commence assessment district proceedings for
construction of a pressurized water system to serve the affected
� area.
2. Acting on the basis of the information and previous
findings of the Shasta County Board of Supervisors , all as set forth
in Exhibits A, B and C, this City Council hereby finds and
, determines , as contemplated by Section 2808 . 5 of the California
Streets and Highways Code, that these proposed special assessment
proceedings and the related project of construction and installation
of water distribution facilities to serve the parcels of land within
the subject area is necessary as a health measure.
3 . On the basis of the finding set forth in Section 2
above, this City Council hereby finds and determines that the
provisions of the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931 shall not apply to the proposed special
assessment proceedings .
4 . This resolution shall constitute final action as

Based upon recent sampling and analysis hy t�e Redding Office of tbe
Central Yalley Regional Water Quality Control Board and Shasta County
Division of Environmental Healt�, I have determined tf�at a public
heait� hazard exists along Deb�ie Lane and Huntington Drive in
ur�inccrpora�ed Ccunty territor;� at tLL2 seutheast bcrder of the City
of Redding.
It is apparent from t�e results of parallel sampling proarams t�at
contamination of indeterminate origin has compromised the safety of
drinking water from private water �el1s along Deb6�ie Lane and buntington
� Drive in C�urn Creek Bottom.
Due to tne nature of t�e underlying strata in this area, conventional
remedies suc� as the drilling of deep wells and/or• the elimination of
contamination from individual sewage disposal syst:ems are either
inadvisahle or impossihle. I am therefore convinced that connection
to a pu�lic water sys.tem must �e made available to all residences.
along Denhie Lane and �untington Drive as soon as possible.
I am requesting t�at the Board of Supervisors concur in this determination
so that appropriate proceedings may be commenced �o connect these
residences�,to the City of Redding water system in the area.

of pot�tial contarninants. •

Anderson Justice Court Judge finalists Roger C:owling, Frank 0'Connor, and
Steven Jahr present to the Board their qualifications for the Anderson Justice
Court Judge vacancy. By a straw vote, Steven Jahr is the choice of a majority of
the Board members. By motion made , seconded an�d carried, the Board of
Supervisors appoints Steven Jahr to the position of Ar�derson Justice Court Judge
to fi11 the unexpired term of Richard McEachen, who was recently appointed to the
Shasta County S�r�erior Court.

Public Health Officer Dr. Stephen Plank refers to the September llth memo
from Water Agency Chief Engineer Larry Preston advising he has met with
representatives of property amers and the City of Redding regarding the water
� supply problems on Debbie Lane and Huntington Drive in the Churn Credc Bottan
' area, that the property owners have already submitted a petition to the City of
Redding requesting annexation and water service, and the City's initial reaction
was favorable. On recommer�dation of Dr. Plank and Mr. Preston, and by motion
� nade, secorx3ed and carried, the Board of Slipervisors concurs with the findings of
a health hazard on Debbie Lane and Huntington Drive, as presented in the Board
meeting September 9 , 1986 , and authorizes the City of Redding to commence
1 assessment district proceedings for construction of a pressurized water systan to
