HomeMy WebLinkAboutReso. 1987-013 - Approving the employment agreement between the city council of the city of redding • RESOLUTION NO. 5715 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE EMPLOYMENT AGREEMENT BETWEEN THE CITY COUNCIL OF THE CITY OF REDDING AND ROBERT M. CHRISTOFFERSON, CITY MANAGER, EFFECTIVE JANUARY 12, 1987, AND AUTHORIZING THE MAYOR TO SIGN SAME. IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1 . That the City Council of the City of Redding hereby approves the Employment Agreement between the City of Redding and Robert M. Christofferson, City Manager, a true copy of which is attached hereto and incorporated herein; and 2. That the Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents, when appropriate. HAYS, Ci y Attorney tiC NA EMPLOYMENT AGREEMENT THIS AGREEMENT made and entered into this 31 S-( day of December, 1986 , by and between the CITY COUNCIL OF THE CITY OF REDDING, State of California, on behalf of the City of Redding, a Municipal corporation, hereinafter referred to as "Council, " and ROBERT M. CHRISTOFFERSON, hereinafter referred to as "Employee, " both of whom understand as follows: WITNESSETH: WHEREAS, Council desires to employ the services of ROBERT M. CHRISTOFFERSON as City Manager of the City of Redding as provided by Chapter 2. 08 of the Redding Municipal Code; and WHEREAS, it is the desire of the Council to provide certain benefits, establish certain conditions of employment, and to set working conditions of said Employee; and WHEREAS, Employee desires to accept employment as City - Manager of the City of Redding; NOW, THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1 . DUTIES. Council hereby agrees to employ ROBERT M. CHRISTOFFERSON as the City Manager of the City of Redding to f perform the functions and duties specified in Chapter 2. 08 of the Redding Municipal Code, and to perform other legally permissible and proper duties and functions as the Council shall from time to time assign. it • • 2. TERM. A. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Council to terminate the services of Employee at any time, subject only to the provi- sions set forth in this Agreement and those found in Chapter 2. 08 of the Redding Municipal Code. B. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Employee to resign at any time from his position with Council, subject only to the provisions set forth in this Agreement. 3 . TERMINATION AND RESIGNATION. In the event the Council wishes to terminate the services of Employee, they shall provide four (4) months ' notice of their intent to terminate the services of Employee. If Employee chooses to resign from employment with the City of Redding, Employee agrees to provide to the Council two (2) months ' notice of the decision of resignation. 4. SALARY. Council agrees to pay Employee for his services rendered pursuant to this Agreement, an annual base salary of $70 , 000 payable in installments at the same time as other employees of Council are paid. 5 . AUTOMOBILE ALLOWANCE. Council agrees to pay Employee an automobile allowance of $300. 00 per month. 6 . HEALTH, RETIREMENT, AND LIFE INSURANCE BENEFITS. Council hereby agrees that Employee shall be added to the City' s medical and dental insurance program funded by the City of Redding for employees and dependents. Additionally, Council agrees to contribute Employee ' s share of the Public Employee -2- • I . • Retirement System cost. Further, Council agrees to add Employee to the City-funded life insurance program which provides a coverage of two times Employee' s annual salary. All items in this paragraph are to be items to be funded by the City of Redding and provided at no cost to Employee. Council agrees to provide for the membership of Employee in the International City Management Association and other appropriate professional associ- ations, and authorize participation in conferences and meetings of organizations which provide professional information to Employee relative to his performance as City Manager of the City of Redding. 7 . RELOCATION EXPENSES. City agrees to reimburse Employee for some costs incidental to relocation, including (1) the cost of maintaining two residences during the interim period until Employee ' s present residence is sold; (2) the cost of moving from an interim residence in Redding to a permanent residence in Redding; and (3) other miscellaneous moving and storage costs, all costs not to exceed $5, 000. 00 . Employee agrees to pay all expenses associated with relocating which exceed the $5,000. 00 figure. 8 . PERFORMANCE EVALUATION. Council shall review and evaluate the performance of Employee semi-annually on a schedule to be determined by the Council. The review and evaluation shall be based upon criteria developed by the Council through consultation with the Employee. The criteria may be added to or deleted from as the Council may from time to time determine, based on further consultation with the Employee. Further, the -3- Mayor shall provide Employee with a Summary of Written Statement of the findings of the Council , and provide an adequate opportunity for the Employee to discuss his evaluation with the Council. Subsequent to evaluation, Council may adjust the base salary and/or other benefits of Employee to such extent as the Council may determine is desirable to do on the basis of the evaluation.
