HomeMy WebLinkAboutReso. 1988-362 - Rescinding resolution no. 88-33, 85-214, and 85-215, and establishing new sewer service and sewer connection charges 41/0 4110 • RESOLUTION NO. $$ t 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING RESCINDING RESOLUTIONS NO. 84-33, 85-214, AND 85-215, AND ESTABLISHING NEW SEWER SERVICE AND SEWER CONNECTION CHARGES WHEREAS, the existing sewer service charges, sewer connection charges, and sewer system special benefit charges for the City of Redding have been established by Resolution Nos. 84-33, 85-214, and 85-215, and WHEREAS, the City of Redding, through its City Council , has adopted an updated Master Sewer Plan dated November 1987, which identifies certain system deficiencies with cost estimates for improvements to eliminate said deficiencies, and WHEREAS, the City of Redding, through its City Council , has approved the Preliminary Design Report for the proposed Stillwater Sewer Treatment Plant which estimates costs for constructing both the initial phase of the treatment plant and the subsequent expansions, and WHEREAS, the Master Sewer Plan and the Preliminary Design Report were available for public inspection and review fourteen (14) days prior to this public hearing, and WHEREAS, the City Council has determined that the existing sewer rates and charges do not produce sufficient revenue to pay all the costs associated with the improvements to the sewer system, and WHEREAS, the City Council deems it to be in the best interests of the City and its citizens that a new schedule of sewer service charges be RESCINDED BY RESO 93=294 N A 4110 41/ established as recommended in Exhibit "A," which is attached hereto and incorporated herein by reference, and WHEREAS, the increase in the sewer service charges shall be used to pay bond debt service to finance the initial construction of the Stillwater system and to expand certain system deficiencies within the Clear Creek system, and WHEREAS, a new schedule of sewer connection charges has now been recommended, which is attached hereto as Exhibit "B" and incorporated herein by reference, and WHEREAS, the sewer connection charges shall be used solely for the correction of sewer system deficiencies as outlined in the updated Sewer Master Plan or the expansion of the Stillwater Treatment Plant as outlined in the Preliminary Design Report, and WHEREAS, staff has reviewed the requirements of CEQA under Section 15273 as it relates to sewer service fees and connection charges and is of the opinion that the proposed increase in charges is not subject to CEQA, with said findings being based on the following, the charges may be used to meet operating expenses, wages, employee benefits, to allow repair and replacement of the existing system, to increase capacity within existing service areas as a product of continuing growth and more efficient use of land, to provide for reconstruction and replacement of substandard portions of the system, to make emergency repairs as the need arises, to pump, transmit and treat sewage originating from existing service areas, to obtain service and supplies, to plan and manage the system and to process payments. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows: -2- 410 1 . Resolution Numbers 84-33, 85-214, and 85-215 are hereby rescinded. 2. Pursuant to Section 14.16.100 of the Redding Municipal Code, revised sewer service charges are hereby established in accordance with the fee schedule which is attached hereto as Exhibit "A. " 3. Pursuant to Section 14.16.070 of the Redding Municipal Code, sewer connection charges are hereby established in accordance with the rate schedule which is attached hereto as Exhibit "B," and the findings made in Exhibit "B" pursuant to Government Code Section 66001 are hereby adopted. 4. For any property that has completed an application for a building permit prior to the enactment date of this resolution, the connection charge shall be as noted in Resolution Numbers 84-33 and 85-214. 5. Commencing five (5) years following the first collection of sewer connection charges set in accordance with this resolution, and annually thereafter, the Public Works Director shall review the estimated cost of the described sewer system improvements, the continued need for the improvements financed by connection charges and the reasonable relationship between the sewer connection charge and the purpose for which it is charged. Any connection charge which remains unexpended or uncommitted for five years or more after being deposited with the City shall be subject to refund as defined in Chapter 5 of Division 1 , Title 7, of the Government Code. 6. HAYS, C ty ttorney -4- EXHIBIT "A" CITY OF REDDING Monthly Sewer Service Charges Class I - Residential Users IA - Single Family - see Table 1 IB - Multiple Family - see Table 2 Class II - Users that discharge a wastewater similar in strength to that of domestic wastewater Class IIA and IIB users charged on the basis of water consumption - see Table 4 Class IIB users charged on the basis of household equivalents - see Table 3 Class III - Users that discharge a wastewater greater than domestic wastewater in strength Class IIIA - Restaurants are the only users in this class based on the measured strength of their wastewater. For restaurants charged on the basis of water consumption, multiply the appropriate amount from Table 4 by 1 .24. For restaurants charged on the basis of household equiva- lents, multiply the appropriate ppropriate amount from Table 3 by 1 .24. Class IIIB - Class IIIB users shall be assessed a fee per household equivalent discharged as shown in Table 3 with the household equivalents determined by the monitoring of flow and wastewater strength. EXHIBIT "B" CITY OF REDDING SEWER CONNECTION CHARGES The following rates shall be paid to the City of Redding prior to the issuance of any sewer connection permit or any physical connection to a public sewer from the premises to which the charges apply. [See Government Code §66001 (a) (1) - (4) 1 The City Council of the City of Redding hereby finds and declares that: The purpose of the connection charges is to provide for sewage conveyance and treatment. The charges will be used to finance the facilities identified below. The sewage conveyance and treatment is needed to service both existing demand in the City of Redding and future increases in demand due to growth in residential development and commercial activity. The sewage conveyance and treatment facilities to be financed by the connection charges are the necessary means for servicing these demands for sewage treatment. The study and analysis prepared by Pace Engineering entitled "City of Redding 1987 MASTER SEWER Plan, " and the report prepared by CH2MHil1 in association with Pace Engineering entitled "Preliminary Design Report for the STILLWATER REGIONAL WASTEWATER FACILITIES, " and the facts and evidence presented, establish that there is a reasonable relationship between the need for the described public facilities and the impacts of all types of development which increase the demand for additional household equivalents of wastewater conveyance and treatment; and, also there is a reasonable relationship between the use of the charges and the types of development for which the fee is charged. The cost estimates for the facilities financed by these charges are reasonable cost estimates for constructing these facilities, and the charges expected to be generated by new development will not exceed the total of these costs. A. SPECIAL BENEFIT CHARGES The Special Benefit Charges established by Resolution No. 84-33 shall not be charged for identified system deficiencies in specific geographical areas of the City. The remaining amount of the cost of correcting said system deficiencies shall be incorporated into the system improvement portion of the connection charge. B. CONNECTION CHARGE FOR SYSTEM IMPROVEMENT A connection charge for system improvements of Three Hundred Fifty and 00/100 Dollars ($350 .00) effective 11/17/88 , Five Hundred Fifty and 00/100 Dollars ($550 .00) effective 7/1/89 , and Eight Hundred Seventy-Five and 00/100 Dollars ($875 .00) • effective 7/1/90 , per household equivalent as defined in the Redding Municipal Code, shall be paid as a condition precedent to any sewer connection into the sewer system. This charge shall not apply, and an exemption shall be given, for properties in the Clover Creek Assessment District. (The Clover Creek Assessment District is an area to be served only by the new regional facility at Stillwater; facilities in the District will be newly constructed; properties in the District will not make use of or benefit from the system improvements financed by this connection charge. ) This sewer connection charge represents the computed reasonable contributive share of the cost of construction of the trunk sewers, interceptors, and pumping facilities. See Tables 1 and 2 attached hereto. C. CONNECTION CHARGE FOR TREATMENT PLANT EXPANSION A connection charge of Five Hundred Fifty Dollars ($550 .00) effective 11/17/88 , Eight Hundred Fifty Dollars ($850 . 00) effective 7/1/89, and One Thousand Seventy-Five Dollars ($1 ,075 .00) effective 7/1/90 , per household equivalent as defined in the Redding Municipal Code, shall be paid as a condition precedent to any sewer connection into the sewer system. This sewer connection charge represents the computed reasonable contributive share of the cost of construction of the next planned expansions of the Clear Creek and Stillwater treatment facilities. See Table 3 attached hereto. D. FRONT FOOTAGE CHARGE For each sewer connection made into a lateral which has not been constructed or financed by means of a local assessment district or through any other means in which the applicant or his predecessor in interest has obtained a vested interest, there shall be paid by the applicant a front footage charge for lateral connection computed at the rate of $14 .00 per foot of street frontage of the premises to be connected. The premises front footage shall be calculated as set forth in the Redding Municipal Code. E. LINE TAP CHARGE When a wye or "T" branch is not available for a sewer connection, the applicant for the sewer connection shall pay a line tap charge as follows: 6"x4" "T" Branch $ 90 .00 6"x6" "T" Branch $ 90 .00 8"x4" "T" Branch $115 . 00 8"x6" "T" Branch $115 .00 -2- • When tapping sewer mains ten inches or larger, the applicant will be required to make a hot tap on the sewer main at the applicant' s expense. The City of Redding will be notified in advance so as to be able to inspect the tap. Inthe event of a hot tap, the normal line tap fee will be waived. -3-
