HomeMy WebLinkAboutReso. 1988-261 - Adopting a policy statement concerning the city's position on payment of connection charges . i RESOLUTION NO. 5,`-„ �,/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ESTABLISHING AND ADOPTING A POLICY STATEMENT CONCERNING THE CITY' S POSITION ON PAYMENT OF CONNECTION CHARGES IN LANDSCAPE-MAINTENANCE DISTRICTS, TO BE INCLUDED IN THE COUNCIL POLICY MANUAL. WHEREAS, the City Council of the City of Redding is charged with the responsibility of establishing municipal policies to guide the various functions of the City, and, where necessary, to establish procedures by which functions are performed; and WHEREAS, regulatory policies established by the City Council are usually adopted by Ordinance and included in the Municipal Code. However, other policies are also established, which by their nature do not require adoption by Ordinance; these policy statements, adopted by Resolution of the City Council, need to be consolidated in a reference document for easy access; and WHEREAS , on August 4 , 1987 , by Resolution No. 87-261 , the City Council adopted a Council Policy Manual to achieve said objectives; and WHEREAS , City Council wishes to establish a policy governing the City' s position on payment of connection charges in Landscape-Maintenance Districts, which policy is set forth in Exhibit "A" attached hereto and incorporated herein by reference; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows : 1 . That all of the above recitals are true and correct; `13 I � • • 8 . J . • 2 . That attached hereto as Exhibit "A" and incorporated herein by reference is a policy statement to be incorporated in the Council Policy Manual establishing the City' s position on payment of connection charges in Landscape-Maintenance Districts. 3 . That the Council Policy attached hereto as Exhibit "A" be and hereby is adopted as the Council Policy of the City of Redding with respect to the City' s position on payment of connection charges in Landscape-Maintenance Districts . HAYS , ity Attorney -2- 00 CITY OF REDDING, CALIFORNIA COUNCIL POLICY SUBJECT POLICY EFFECTIVE LANDSCAPE-MAINTENANCE DISTRICTS: NUMBER DATE PAGE PAYMENT OF CONNECTION CHARGES 8/2/88 BACKGROUND The City of Redding has required and will continue to require the formation of landscape-maintenance districts in conjunction with the approval of subdivi- sions which are located on the City' s arterial street system. These develop- ments are required to install landscaping within the public right-of-way, including all associated improvements such as irrigation systems and automatic valve controls. The maintenance districts are thereafter responsible for the yearly maintenance of the landscaping. The issue is: Should the developer also pay all the existing water and electric meter connection charges? PURPOSE It is the purpose of this policy to clearly delineate the responsibility of subdivision developers with respect to the provisions of water and electric meters associated with landscape maintenance districts. POLICY • It shall be the policy of the City of Redding that the developer(s) of subdivisions , where landscape-maintenace districts are required to be formed as a condition of subdivision approval , shall pay all water and electric meter fees required to connect to the City utility systems. Such fees include, but are not limited to, meter fees, connection charges, development fees, benefit fees , and inspection fees. PROCEDURE The conditions of approval for subdivisions where landscape-maintenance district formation is required shall specify that the above fees shall be the responsibility of the developer.
