AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING THE REDDING CITY CODE, 1959, AS AMENDED, BY ADDING ARTICLE IV, ENTITLED "WILD BIRDS", TO CHAPTER 5, INCLUDING SECTIONS 5-43 THROUGH AND INCLUDING 5-46, PROVIDING FOR THE PROTECTION OF WILD BIRDS AND THE ESTABLISHMENT OF DESIGNATED BIRD SANCTUARIES. The City Council of the City of Redding does hereby ordain as follows: Section 1. The Redding City Code, 1959, as amended, is hereby amended by adding Article IV to Chapter 5, as follows: Section 5-43. "ARTICLE IV Purpose. WILD BIRDS The purpose of this article is to afford additional protection to wild birds within the City of Redding and to aid in the preservation of all species of wild birds typical to this geographical area, by establishing designated bird sanctuaries on portions of property owned or leased by the City of Redding and located within the City's boundaries, in the belief that wild birds not only have great economic value in aiding in the destruction of insect and worm pests, but also provide one of the best opportunities for our citizens to observe wild life, and in the further belief that the protection and preservation of wild birds will benefit all the citizens of our City. Section 5-44. Bird Sanctuaries. That portion of the City of Redding owned by the City and devoted to park or designated types of recreational uses and most commonly known as Turtle Bay and Turtle Bay East, and depicted on that map of a designated portion of the City of Redding attached hereto as "Exhibit A" and incorpor- ated herein by reference, is hereby declared to be a wild bird sanctuary. All of the prohibitions set forth in the article of which this section is a part shall apply within i any wild bird sanctuary established by the City Council. Section 5-45. Molesting of birds and bird eggs prohibited. Within any established wild bird sanctuary, no person shall, at any time, hunt, pursue, kill, trap, take or destroy any bird of any species whatsoever, and no person shall molest or damage the nest or the eggs of any bird of any species located within the confines of said sanctuary, excepting however, that the City Council may, at any tine, when, in its opinion, starlings or crows or any other species of bird become so numerous within a designated bird sanctuary as to constitute a public nuisance or a danger to the public health, direct the Animal Control Officer to take such measures as may be necessary to control the problem and eliminate the public nuisance or danger to the public health. Section 5-46. Bird sanctuaries - erection of signs. In any area designated a bird sanctuary by the City Council, the City Council shall cause to be erected signs notifying the public that the designated area is a bird sanctuary,and such signs shall be placed at appropriate locations within and along the perimeter of said sanctuaries." Section 2. The City Clerk of the City of Redding shall certify to the adoption of this ordinance and shall cause it to be published in accordance with law. I HEREBY CERTIFY that the foregoing ordinance was in- troduced and read at a regular meeting of the City Council of the City of Redding on the 17th day of April, 1972, and was duly read and adopted on the 1st day of May, 1972, at a regular meeting of the City Council by the following vote: AYES: COUNCILMEN: Anderson, Chatfield, Denny, Fulton, and Moty NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None ATTEST: MILDRED L.
