IT IS HEREBY RESOLVED by the City Council of the City of Redding that the City Council hereby adopts the attached "City of Redding Consultant Selection Procedures for State and Federally Funded Projects" as the procedure to be followed by the City in its selection of a Consultant for the preparation of an Environmental Impact Report for the Diestelhorst Bridge Replacement. HAYS, City Attorney I a� VJ • • • CITY OF REDDING CONSULTANT SELECTION PROCEDURES FOR STATE AND FEDERALLY FUNDED PROJECTS SECTION 1 - ENGAGEMENT OF CONSULTANTS Professional consultants are utilized by the City of Redding to augment the City's professional capabilities during peak workload periods or other critical periods and/or to provide specialized services not presently available within the City's various departments. SECTION 2 - EVALUATION OF CONSULTANTS The City of Redding provides for a fully open and competitive ' process in consultant selection. Consultant selection shall consist of comparative evaluation of the qualifications presented in proposals made to the Department within the City that is in charge of the project. SECTION 3 - CONSULTANT PROPOSAL SOLICITATION A. Request for Proposal (RFP) : The City shall advertise the availability of RFPs in a major newspaper a ofgeneral circulation or a technical p p publication of widespread circulation. RFPs may additionally be sent out to consultant firms known to be qualified to provide the services required to do the work. All interested parties, including Disadvantaged Businesses Enterprises (DBE) are extended the opportunity to respond to the RFP. The RFP shall include an accurate description of the work to be performed, significant criteria for consultant evaluation including criteria in making consultant selection. The RFP shall require the consultant to include their cost for the required services as designated by the RFP. The RFP shall also describe the method of payment to compensate the selected consultant for work to be performed under the terms of the agreement. The RFPs shall be in compliance with the DBE program and requirements. The City Manager shall appoint a selection committee comprised of three (3) to five (5) members who are familiar with the technical aspects of the project problem and the anticipated scope of services to be provided. Representa- tives from other agencies, public utilities, and the construc- tion industry who have experience in the problem area may be selected to serve on the selection committee. The selection committee shall evaluate the proposals based on the professional qualifications necessary for the timely and satisfactory completion of the project. The following criteria shall be utilized in the selection process. • • • • • 1. All qualifications and performance data submitted by the consultant relevant to the project team, including a verification of data and reference. 2. Demonstrated understanding of the project problem as evidenced in the proposal . 3. Consultant' s demonstrated capability to explore and develop innovative or advanced techniques or designs. 4. Consultant's past record of performance in similar projects related to control of costs, quality of work, meeting schedules, and the number and type of construction change orders (if applicable) . 5. The present workload of the firm and the availability of staff for the project. 6. Familiarity with the City's design and construction specifications and procedures. 7. City' s prior experience with the consultant. 8. Familiarity with the geographical area of the project. 9. Consideration of distribution of contracts on an equitable basis among the most qualified firms on the register. 10. Specialized equipment available to the consultant which is relevant to the completion of the project. 11 . Financial responsibility of the consultant. 12. Cost for required services. 13. Compliance with the DB programs and requirements. 14. Other criteria as established by the City or specific to the project. The selection committee shall recommend to the City Council the successful candidate. B. Noncompetitive Negotiated Agreements: When special conditions arise and when authorized by the Redding City Council , it is possible to go directly to a noncompetitive, negotiated contract. The details of the special conditions shall be carefully documented and approval obtained from Caltrans and FHWA in order to obtain Federal reimbursement. Conditions under which noncompetitive negotiated contracts may be acceptable include the following: • • • • 1. Only one organization qualified to do the work. 2. An emergency of such magnitude that delay cannot be permitted. 3. The federal grantor agency authorizes noncompetitive negotiation. 4. After solicitation of a number of sources, competition is determined to be inadequate. C. Agreements Under $5,000: Service agreements and other consultant agreements under $5,000 may be handled through a relatively simple and informal method of procurement that is sound and appropriate for procurement of services, supplies , or property, costing in the aggregate not more than $5,000. The details of the basis for selection shall be well documented as in the case of other negotiated agreements. D. Disadvantaged Business Enterprise: It is a national policy to award a fair share of contracts to DB firms. Accordingly, the City shall take affirmative steps to assure that DB firms are utilized when possible as consultants. Affirmative steps by the City shall include the following: 1. Include Caltrans approved certified DB firms on solicitation lists . 2. Assuring that DB firms are solicited whenever there are prospective consultants. 3. When economically feasible, dividing total requirements into smaller tasks so as to permit maximum DB participation. 4. Where time permits , establishing schedules which will encourage participation by DB. 5. Using the services and assistance of the Small Business Administration, the Minority Business Development Agency of the Department of Commerce, and the Office of Small and Disadvantaged Business Utilization of the Department of Transportation.
