HomeMy WebLinkAboutReso. 1988-200 - Approving the agreement between the city of redding and the redding redecelopment agency 0 RESOLUTION NO. gg'2O,Q , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE AGREEMENT BETWEEN THE CITY OF REDDING AND THE REDDING REDEVELOPMENT AGENCY FOR A REDEVELOPMENT PLAN, AND AUTHORIZING THE MAYOR TO SIGN SAME. BE IT RESOLVED by the City Council of the City of Redding as follows: 1. The City Council of the City of Redding hereby approves the Agreement between the City of Redding and the Redding Redevelopment Agency providing for preparation of a redevelopment plan for the Highway 273 Corridor Survey Area. 2. The Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents, when appropriate. 3. A true copy of the Agreement referred to herein is attached hereto and made a part hereof. HAYS, ity ttorney - 1 - i • 1110 AGREEMENT THIS AGREEMENT, entered into on the day of , 1988, by and between the CITY OF REDDING, a municipal corporation, hereinafter called "City," and the REDDING REDEVELOPMENT AGENCY; a public body, herein- after called "Agency": W I T N E S S E T H: WHEREAS, the City Council of City, acting pursuant to the provisions of the California Community Redevelopment Law (Health and Safety Code Section 33000, et seq. ) , has activated Agency by Resolution No. 2407, adopted August 4, 1958; and WHEREAS, pursuant to the Community Redevelopment Law, Agency is performing a public function of City and may have access to services and facilities of City; and WHEREAS, the City and Agency entered into a Cooperation Agreement dated October 28, 1985, and amended this Agreement on December 16, 1985; and WHEREAS, City and Agency have undertaken proceedings for the adop- tion of the Highway 273 Corridor Redevelopment Survey Area in the City of it Redding; and II WHEREAS, City has set aside $30,000 in Community Development Block Grant Funds (CDBG) for the development of a Redevelopment Plan for the Highway 273 Corridor Redevelopment Survey Area; NOW, THEREFORE, IT IS AGREED between the parties hereto as follows: 1. The above recitals are true and correct; 2. The Cooperation Agreement between City and Agency is in full force and effect and is incorporated by reference herein; 3. City shall pay to Agency the sum of Thirty-Thousand Dollars ($30,000) for the development of a Redevelopment Plan and related services. Payment of said funds shall be in accordance with the terms of the aforemen- tioned Cooperation Agreement; 4. Agency shall repay funds advanced under this Agreement in accordance with the terms of the aforementioned Cooperation Agreement only if the project is formed. If the project is not formed, then the repayment of the $30,000 is not required; and 5. Agency shall comply with all requirements of the CDBG program and shall insure that any contractors and subcontractors used under this Agreement shall comply with these requirements. These regulations are incorporated herein by reference: - 1 - • National Environmental Policy Act of 1969 Title VI of the Civil Rights Act of 1964 Title VIII of the Civil Rights Act of g 1968, as amended Section 109 of the Housing and Community Development Act of 1974, as amended Section 3 of the Housing and Community Development Act of 1968, as amended ( Executive Order 11246, as amended Executive Order 11063, as amended Section 504 of the Rehabilitation Act of 1973, as amended Age Discrimination Act of 1975, as amended Titles II and III of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 Labor Standards requirements as set forth in 24 CFR Part 570, Subpart K Executive Order 11988 Executive Order 11288 Section 102(a) of the Flood Disaster Protection Act of 1973 OMB Circulars A-87; A-102, Revised: A-110; and, A-122 Hatch Act Lead-Based Paint Poisoning Prevention Act IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and year above written.
