RESOLUTION NO. ir`r in A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF REDDING AND THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION (CALTRANS) , FOR THE STATE ROUTE 44 INTERCHANGE AT SHASTA VIEW DRIVE, AND AUTHORIZING THE CITY MANAGER TO SIGN ALL NECESSARY DOCUMENTATION. BE IT RESOLVED by the City Council of the City of Redding as follows: 1 . That the City Council of the City of Redding hereby approves the Memorandum of Understanding between the City of Redding and Caltrans for the State Route 44 Interchange at Shasta View Drive, a true copy of which is attached hereto. 2 . That the City Manager of the City of Redding is hereby authorized and directed to sign said Memorandum of Understanding on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding on the aforesaid document, when appropriate. NICHOLS , City Y Attorney S) bc 110 MEMORANDUM OF UNDERSTANDING State Route 44 Interchange at Shasta View Drive This is a "Memorandum of Understanding" (MOU) between the State of California, Department of Transportation (Caltrans) , and the City of Redding (City) . This MOU covers the project development, right-of-way acquisition, and work phases involved in constructing an interchange on State Route 44 at Shasta View Drive. This MOU is solely a guide to the obligations, intentions, and policies of the parties involved. It is not intended to authorize funding or project effort, nor is it a legally binding contract. Commitments providing for the deposit of funds and/or specific work phases will be covered by one or more separate COOPERATIVE AGREEMENTS as outlined herein. The following responsibilities have been identified and are proposed to be agreed to by both parties: 1. City will fund 100% of all cost related to the relocation and reconstruction of Tarmac Road at an alternate intersection location with Shasta View Drive. Costs shall include, but not be limited to, road right-of-way, right-of-way for utilities, design and construction engineering and preparation of contract documents, advertising and award, and construction. City will consult with Caltrans on the design of the Tarmac Road relocation. The limits of relocated road are shown on Exhibit "A" as Tarmac Road, Segment 1. 2. The City will fund 100% of all right-of-way cost related to that portion of right-of-way needed for Shasta View Drive construction north of the 411 present right-of-way used for Tarmac Road. Cost will include right-of-way, utility relocation, and associated expenses. 3. Caltrans will attempt to minimize right-of-way needed to relocate Tarmac Road, Segment 2, shown on Exhibit "A" near the present airport facilities and tapers for Shasta View Drive north of the present Tarmac Road. 4. Caltrans will be the "Responsible Agency" for preparation of Environmental Document. 5. Caltrans will seek programming and funding of this project through the California Transportation Commission (CTC) for the State's portion of said interchange cost which excludes the City cost covered by this MOU. ,I I Additional City or County funding to offset the State's cost portion would be a basis for the CTC to consider advancing this project in scheduling. Normal programming for this project is expected in 5 to 10 years fromthe .. . date of this MOU. 6. It is understood that the Shasta View Drive overcrossing will have a vertical design speed of 45 MPH and a horizontal alignment as shown on attached Exhibit "A. " The interchange project will be subject to Federal Highway Administration approval . 7. City and County acknowledge that it will protect from future development all additional right-of-way needed for said interchange in NW quadrant of interchange by land acquisition or trade of land between City or County and developers subdividing this area. • 8. Caltrans and City concur that no new freeway agreement will be required and that the City accepts the terms and conditions of the existing freeway agreement executed December 20, 1965, between Caltrans and Shasta County for construction of said future interchange herewith attached as Exhibit B. 9. Caltrans will prepare cooperative agreements defining more specifically the responsibilities and costs of both parties for each phase of work requiring expenditure of funds or staff services by Caltrans. 10. All phases of the project, from inception through construction, whether done by City or Caltrans, will be developed in accordance with all policies, procedures, practices, and standards that Caltrans would normally follow.
