A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
IMPLEMENTING A SURPLUS PROPERTY AUCTIONEER PROGRAM, AND
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
CONTRACT WITH EPPERSON BROTHERS AUCTION TO PROVIDE FOR THE
DISPOSAL OF CITY SURPLUS PROPERTY BY AUCTION.
WHEREAS, in the past, a great deal of staff time has been
required in disposing of City surplus property; and
WHEREAS , if the City were to enter into a contract with an
auctioneer to dispose of surplus property, the benefits would
include cost savings in City personnel involvement, anticipated
increase in revenue, and minimized storage-space requirements;
and
WHEREAS , it has been determined that it would be in the best
interests of the City of Redding to implement a surplus property
auctioneer program; and
WHEREAS, it has been determined by staff that Epperson
Brothers Auction is the only area auctioneer currently capable of
handling the proposed auction program; and
WHEREAS, it has been determined that this matter is
categorically exempt from the provisions of CEQA;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of
the City of Redding as follows:
1 . That the foregoing recitals are true and correct.
2 . That a Surplus Property Auctioneer Program be and
hereby is implemented, whereby the City will contract with an
auctioneer to dispose of the City' s surplus property.
3 . That the City Manager is hereby authorized and directed
to enter into negotiations with and to execute a contract with
Epperson Brothers Auction, along the lines of the recommendations
contained in the accompanying staff report, with any other
additions recommended by the City Attorney, including the
following:

a) City Council hereby waives the public liability
insurance requirements by Epperson Brothers Auction;
b) Epperson Brothers Auction, its officers , agents,
employees and invitees , are to hold the City of Redding
and its officers, agents and employees free from any
all claims (with this wording to be expanded in the
final contract) .
c) That the contract state that Epperson Brothers Auction
is a contractor, and neither it nor any of its
employees will be considered employees of the City of
Redding.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 5th day of April , 1988 , and was
duly adopted at said meeting by the following:
