A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE METER AGREEMENT BETWEEN THE CITY OF REDDING,
PARK MARINA VILLAGE HOMEOWNERS ASSOCIATION, INC. , AND
LANGELEON INVESTMENTS, DBA PARK MARINA VILLAGE LTD. , AND
AUTHORIZING THE MAYOR TO SIGN SAME.
IT IS HEREBY RESOLVED by the City Council of the City of
Redding as follows :
1 . That the City Council of the City of Redding hereby
approves the Meter Agreement between the City of Redding, Park
Marina Village Homeowners Association, Inc. , and Langeleon
Investments , doing business as Park Marina Village Ltd. , a true
copy of which is attached hereto and incorporated herein; and
2 . That the Mayor of the City of Redding is hereby
authorized and directed to sign said Agreement and all necessary
documents in connection therewith on behalf of the City of
Redding, and the City Clerk is hereby authorized and directed to
attest the signature of the Mayor and to impress the official
seal of the City of Redding on the aforesaid documents, when
appropriate.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 1st day of March , 1988 , and was
duly adopted at said meeting by the following vote:

AGREEMENT
THIS AGREEMENT entered into this day of February,
1988, by and between the CITY OF REDDING, a Municipal Corporation
and General Law City, hereinafter referred to as "CITY"; PARK
MARINA VILLAGE HOMEOWNERS ASSOCIATION, INC. , a California
Corporation, of Post Office Box 1994 , Redding, California 96099 ,
hereinafter referred to as "ASSOCIATION" ; and LANGELEON
INVESTMENTS, DOING BUSINESS AS PARK MARINA VILLAGE LTD. , a
California Limited Partnership, of 10341 Arnwood Road, Lake View
Terrace, California 91342 , hereinafter referred to as "VILLAGE" :
WITNESSETH:
WHEREAS, VILLAGE is the owner of Parcel 1; and
WHEREAS, ASSOCIATION is the owner of Parcel 2; and
WHEREAS, water service to ASSOCIATION is provided by a
private water line crossing Parcel 1 in order to service Parcel
2; and
WHEREAS, water service to both Parcel 1 and Parcel 2 is
currently single-metered; and
WHEREAS, ASSOCIATION wishes to establish a metering point to
provide separate metering for water usage associated with Parcel
2; and
WHEREAS , ASSOCIATION further wishes to establish an electric
meter location in order to provide a separate billing of
electrical energy used by ASSOCIATION for its common area use;
and

WHEREAS, Exhibit "A" attached hereto and incorporated herein
is a graphic representation of the parcels involved and the
private water line system involved;
NOW, THEREFORE, the parties agree as follows:
1. ASSOCIATION agrees to pay.. -.to CITY $675 . 00 for the
installation of a two-inch water meter in the location as shown
on Exhibit '"A' for the purpose of providing separate monthly
water billings between ASSOCIATION and VILLAGE. •
ASSOCIATION agrees to install new electrical panel with
meter socket to provide for the separate billing of the
electrical energy used by ASSOCIATION for common area use.
ASSOCIATION further agrees to pay CITY $722 .50 for inspection
fees and the cost of the installed electric meter.
3. CITY agrees to read, on a monthly basis, both the
existing master meter located on Park Marina Drive and the meter
to be installed pursuant to this Agreement, and, further, to
provide separate billings to ASSOCIATION and VILLAGE representing
the individual water use of each.
4 . ASSOCIATION and VILLAGE hereby agree to allow CITY to
enter Parcels 1 and 2 in order to complete the construction
contemplated by this Agreement, as well as to pursue any repairs
to the meter placed on Parcel 2 which may be necessary in the
future. ASSOCIATION and VILLAGE further agree to allow CITY
meter readers to cross Parcels 1 and 2 for the purpose of reading
the meters contemplated by this Agreement.

5 . ASSOCIATION and VILLAGE hereby acknowledge that the
water line crossing Parcels 1 and 2 is a private water line, and
agree that the installation of the water meter contemplated by
this Agreement is for the sole benefit of ASSOCIATION and
VILLAGE. Further, ASSOCIATION and. VILLAGE agree that CITY has no
responsibility for the operation or maintenance of the water line
existent on Parcels 1 and 2..
6. ASSOCIATION acknowledges that existing fire flows
through the private water line on Parcel 2 are inadequate, and
thatit will be necessary to extend, at the minimum, a six-inch
water line to Parcel 2 in order to meet fire flow standards.
Such extension, if undertaken, shall be the sole responsibility
of A,S.SOCIATION or its successor-in-interest.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the day and year first above written.
