A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING ITS INTENTION TO VACATE A PORTION OF A STREET
RIGHT-OF-WAY ON THE WEST SIDE OF THE INTERSECTION OF
CATERPILLAR ROAD AND TWIN VIEW BOULEVARD, ADJACENT TO
PROPERTY LOCATED AT 5292 CATERPILLAR ROAD (A-13-87) .
WHEREAS, certain real property, namely a portion of a street
right-of-way on the west side of the intersection of Caterpillar
Road and Twin View Boulevard, adjacent to property located at
5292 Caterpillar Road, and described in Exhibit "A" attached
hereto and incorporated herein by reference, has been heretofore
relinquished to the City of Redding by the State of California,
as the same is set forth on a map and/or plan on file in the
office of the City Clerk of the City of Redding, being more
particularly shown on the map attached hereto and incorporated
herein by reference; and
WHEREAS , it is believed by and it appears to the City
Council of the City of Redding that, subject to the conditions
hereinafter set forth, a portion of said street right-of-way on
the west side of the intersection of Caterpillar Road and Twin
View Boulevard, adjacent to property located at 5292 Caterpillar
Road, as shown on the attached map is not necessary; and
WHEREAS, the Director of Public Works of the City of Redding
has duly investigated the proposed abandonment of said portion of
the street right-of-way, and has advised the City Council that,
subject to the conditions hereinafter set forth, there is no
indication that it will ever be required; and

WHEREAS , the Planning Commission of the City of Redding has
held a public hearing regarding the abandonment of said portion
of the street right-of-way, and at the conclusion of said hearing
has recommended that saidortion of the street right-of-way, as

shown on the attached map, be abandoned, subject to the
conditions hereinafter set forth; and
WHEREAS, the City Council of the City of Redding elects to
proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as the same
is set forth in Section 8300 , et seq. , of the Streets and
Highways Code of the State of California, with the provision that
this Resolution shall be deemed a Resolution of Intention;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Redding as follows:
A. That all of the foregoing recitals are true and
correct.
B. That the City Council intends to and hereby declares
its intention to vacate and abandon a portion of the street
right-of-way on the west side of the intersection of Caterpillar
Road and Twin View Boulevard, adjacent to property located at
5292 Caterpillar Road, as described in Exhibit A and shown on the
map attached hereto, subject to the following conditions :
1 . Necessary easements shall be granted to the City of
Redding for overhead and underground facilities.
2 . At the time of development of the adjacent property for
any use , the property owner shall construct vertical
curb, gutter, and sidewalk, and install the necessary
aggregate base and asphalt concrete surfacing between
the gutter and the travelled lane for the length of the
frontage along Caterpillar Road, Twin View Boulevard,

and the southwest cornier of the rounding of Mason
Street and Caterpillar Road.
3 . Excepting and reserving therefrom, pursuant to the
provisions of Section 8340 of the Street and Highways
Code and for the benefit of Pacific Bell Company, the
permanent easement and the right at any time or from
time-to-time to construct, maintain, operate, replace,
remove, renew and enlarge lines of pipe, conduits,
cable, wires, poles and other convenient structures,
equipment and fixtures for the operation of telegraphic
and telephone lines and other communication facilities,
including access and the right to keep the property
free from inflammable materials and wood growth, and
otherwise protect the same from all hazards, in, upon,
over and across that portion of Twin View Boulevard
abandoned.
4 . The abandonment shall provide for a 10-foot public
electrical service easement for the purpose of
maintaining the existing overhead facility; the 10-foot
easement is described as five feet on each side of the
existing pole line.
5 . The existing CATV pole line shall be maintained,
including the easement.
6 . Prior to executing a Resolution of Abandonment,
evidence shall be submitted to the City of Redding to
verify that the abandonment area and the adjoining
parcel to the west are under the same ownership.
7 . A parcel map shall be recorded to show that the
abandoned area is merged with the adjacent westerly lot
owned by the applicant.
BE IT FURTHER RESOLVED that all persons interested in or
objecting to the proposed abandonment will be heard on Tuesday,
March 15 , 1988 , at the hour of 7 : 00 p.m. , or as soon thereafter
as the matter may be heard, in the City Council Chambers and
Police Department Building located at 1313 California Street,
Redding, California.
BE IT FURTHER RESOLVED that the Director of Public Works of
the City of Redding be and hereby is instructed to post or cause
to be conspicuously posted, at points not more than 300 feet

apart in distance and along the line of property now proposed to
be abandoned, notices of this intention to vacate and abandon
said portion of the street right-of-way. Said notices shall set
forth the passage of this Resolution of Intention, and shall set
forth the time and place of hearing as hereinabove set forth. At
least three such notices shall be posted in the manner set forth
above, and posting of said notices shall be completed not less
than 15 days prior to the date of the hearing.
BE IT FURTHER RESOLVED that the City Clerk shall certify to
the passage and adoption of this Resolution of Intention and
shall cause the same to be published once in a newspaper of
general circulation in the City of Redding at least 15 days
before the date set for public hearing of protests to the
aforesaid proposed vacation.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 16th day of February , 1988 , and was
duly adopted at said meeting by the following vote:

Beginning at a point on the westerly right of way line of the
