A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE MOST EASTERLY 95 .00 FEET OF THE
10-FOOT SEWER EASEMENT SHOWN ON LOT 1 OF TIMBER LANES
SUBDIVISION RECORDED IN THE OFFICE OF THE COUNTY RECORDER
DECEMBER 9 , 1964 , IN BOOK 12 OF MAPS AT PAGE 59 , SHASTA
COUNTY RECORDS , AS PART OF THE CONSTRUCTION OF THE LAKE
BOULEVARD PLAZA SHOPPING CENTER. APN 106-380-22/23 .
WHEREAS, a 10-foot sewer easement shown on Lot 1 of the
Timber Lanes Subdivision recorded in the office of the County
Recorder December 9 , 1964 , in Book 12 of Maps at page 59 , Shasta
County Records , has heretofore been reserved unto the City of
Redding as shown on the map attached hereto and incorporated
herein by reference; and
WHEREAS, the City of Redding has received a request to
abandon the most easterly 95 . 00 feet of said 10-foot sewer
easement, in exchange for a new easement in a different location
to be dedicated to the City on a parcel map; and
WHEREAS , the City Public Works Department has determined
that it is in order to vacate the most easterly 95 . 00 feet of
said 10-foot sewer easement, provided a new easement has been
dedicated and recorded in favor of the City of Redding in a
different location prior to this Resolution being recorded with
the Shasta County Recorder; and
WHEREAS, the City Council of the City of Redding proposes to
vacate the most easterly 95 . 00 feet of said 10-foot sewer
easement, as more particularly depicted in Exhibit "A" attached

hereto and made a part hereof by reference , in accordance with
the provisions of the Public Streets , Highways and Service
Easements Vacation Law (Streets and Highways Code, Part 3 ,
Chapter 4 , Sections 8330 , et seq. ) , provided a new easement has
been dedicated and recorded in favor of the City of Redding in a
different location prior to this Resolution being recorded with
the Shasta County Recorder; and
WHEREAS , the City Council of the City of Redding finds and
determines that the most easterly 95 . 00 feet of said 10-foot
sewer easement will not be required, provided the new easement as
set forth above has been dedicated and recorded in favor of the
City;
NOW, THEREFORE, the City Council of the City of Redding
resolves and orders as follows :
1 . Provided a new easement in a different location has
first been dedicated and recorded in favor of the City of
Redding, it is hereby declared that the most easterly 95 . 00 feet
of the 10-foot sewer easement shown on Lot 1 of the Timber Lanes
Subdivision, recorded in the office of the County Recorder
December 9 , 1964 , in Book 12 of Maps at page 59 , Shasta County
Records, as more particularly depicted in the map attached
hereto, is no longer necessary and is hereby vacated as a sewer
easement.
2 . That the City Clerk of the City of Redding be and
hereby is directed to record a certified copy of this Resolution,
attested to by the City Clerk under the seal of the City of

•Redding, in the Office of the Shasta County Recorder, after the
new easement set forth above has been dedicated to the City of
Redding and recorded on a parcel map.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 2nd day of February , 1987 , and was
duly adopted at said meeting by the following vote:
AYES: COUNCIL MEMBERS : Carter, Fulton , Gard , Johannessen , & Dahl
NOES: COUNCIL MEMBERS: None
ABSENT: COUNCIL MEMBERS: None
