Home My WebLink AboutReso. 1988-024 - Approving program supplement no. 17r-1 to the local agency/state agreement for federal-air projects # I RESOLUTION NO. . ?-„2 y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING PROGRAM SUPPLEMENT NO. 17R-1 TO THE LOCAL AGENCY/STATE AGREEMENT FOR FEDERAL-AID PROJECTS NO. 02-5068 ENTERED INTO BETWEEN THE CITY OF REDDING AND THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION, AND AUTHORIZING THE MAYOR TO SIGN ALL NECESSARY DOCUMENTATION IN CONNECTION THEREWITH. WHEREAS , a Master Agreement between Caltrans and the City of Redding providing administrative guidelines pertinent to Federal- Aid Projects was entered into on July 5 , 1977 ; and WHEREAS , 15 individual projects have been cooperatively constructed; and WHEREAS , Supplement No. 16 for the Sacramento River bridge crossing west of Diestlehorst, and Supplement No. 17 for the South Street/ACID Bridge were approved by City Council by Resolution No. 87-153 adopted May 19 , 1987 ; and WHEREAS , attached Supplement No. 17R-1 dated November 24 , 1987 , for the project on South Street at the ACID canal bridge, BR No. 6-C-152 , requires City Council approval; and WHEREAS , it is the recommendation of the Department of Public Works that Supplement No. 17R-1 be approved; and WHEREAS, it is deemed to be in the best interests of the City of Redding to approve said Supplement; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: oQ ii iI . , I . That the City Council of the City of Redding hereby approves Supplement No. 17R-1 to the Local Agency-State Agreement for Federal-Aid Projects No. 2-5068 , a copy of which is attached hereto and incorporated herein by reference; and 2 . That the Mayor of the City of Redding is hereby authorized and directed to sign said Supplement and all necessary documentation on behalf of the City of Redding in connection therewith, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents, when appropriate. All maintenance, involving the physical condition and the operation of the improvements, referred to in Artical VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements . 2 . In executing this Program Supplemental Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Programs . 3 . The Local Agency will advertise, award, and administer this project and will obtain the State ' s concurrence prior to either award or rejection of the contract. 4 . The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement ( PR-2 ) , or its modification ( PR-2A) , and accepts any increases in Local Agency Funds as shown on the Finanace or Bid Letter or its modification as prepared by the Divison of Local Streets and Roads . 5 . BRM-Y245( 1 ) Prog. Supp . 'No . 17R-1 Revised SPECIAL COVENANTS FOR CALTRANS LOCAL AGENCY AUTOMATED PAY SYSTEM (LAAPS) Caltrans has granted approval to the City of Redding ' s request for the use of Caltrans Local Agency Automated Pay System. A. City of Redding will abide by the requirements as set forth in the State of California , Department of Transportation ' s Policy and Procedure Memorandum P80-10 , dated March 20 , 1980 , and as revised February 19, 1981 regarding the use of Caltrans Local Agency Automated Pay System. B . Attention is called to some pertinent requirements for the use of the LAAPS . 1 . Subsequent to the bid opening, the Detail Estimate as based on the bid of the successful bidder will determine the Local Agency' s share of the construction cost . (a) Should the Local Agency' s share of the construction cost be greater than the amount on deposit with the State for this purpose, a supplemental deposit of the difference will be required prior to the award of the contract . (b) Any Local Agency Funds on deposit with the State not required for the Agency ' s share of the con- struction cost as determined by the Detail Estimate will be returned to the Agency. 2 . The Local Agency agrees to provide the following informa- tion to the State upon award of the contract : (a) Contract award date . (b) Certification of Contractor ' s Licence form for verification by the State. (c) Contract approval date & Contractor' s first work day. (d) Contractor ' s name and the voucher mailing address (for the warrant) including any subsequent change of address . (e) Name, address, telephone number and title of the local agency representative who can accept legal actions filed against the contract under the Civil Code.
