A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF
INTENTION TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER
CHAPTER 9 . 36 OF THE REDDING MUNICIPAL CODE ON THE
SUBSTANDARD GARAGE AND DEBRIS LOCATED ON CERTAIN REAL
PROPERTY AT 586 MARKWOOD DRIVE, IN THE CITY OF REDDING
(OWNED BY EMIL BENBROOK AND BERNICE BENBROOK, TRUSTEES UNDER
THE EMIL AND BERNICE BENBROOK 1987 TRUST) .
WHEREAS, the provisions of Chapter 9 . 36 of the Redding
Municipal Code provide that all buildings or structures located
within the City of Redding which are structurally unsafe or are
dilapidated from old age, neglect, decay or other causes which
constitute a fire menace or are dangerous to human life or a
likely resort for vagrant or dissolute persons , may be declared a
nuisance by the City Council of the City of Redding and there-
after abated as provided therein; and
WHEREAS , the Building Official of the City of Redding has
made an inspection of the garage located on real property as
hereinafter described and has declared it to be unsafe and/or a
hazard to safety, health, and public welfare; and

WHEREAS , it has been determined that this matter is categor-
ically exempt from the provisions of CEQA; � .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Redding that it is the intention of this City Council to
begin legal proceedings of abatement under Chapter 9 . 36 of the
Redding Municipal Code on the substandard garage situated on the
property described in Exhibit "A" attached hereto and made a part
hereof. a

BE IT FURTHER RESOLVED that said building mentioned herein-
above is hereby declared to be a public nuisance as provided by
Chapter 9 . 36 of the Redding Municipal Code and is hereby ordered
to be abated by repair, rehabilitation, demolition, or removal.
BE IT FURTHER RESOLVED that the Fire Marshal and the Board
of Appeals of the City of Redding are hereby directed to take all
proceedings provided in Chapter 9 . 36 of the Redding Municipal
Code.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Redding be and hereby is authorized and directed to forward a
certified copy of this Resolution to the Shasta County Recorder
for recordation.
I HEREBY CERTIFY that the foregoing Resolution was intro-
duced and read at a regular meeting of the City Council of the
City of Redding on the 21st day of November , 1989 , and
was duly adopted at said meeting by the following vote:

That real property situate in the County of Shasta, City hof
Redding, State of California, and is described as follows:
All that portion of the Northwest one-quarter of the Southeast
one-quarter of Section 6, Township 31 North, Range 4 West,
M.D.B. &M. , described as follows:
COMMENCING at a point on the North-South mid-section line of
said Section 6, which bears North 0°37 ' West, 1516.68 feet from
the South one-quarter corner thereof; thence, North 89°28 '27"
East, 475. 00 feet; thence, North 0°37 ' West, 25.00 feet to the
point of beginning of this parcel; thence, continuing North
0°37 ' West, 75.00 feet; thence, North 89°28 '27" East, 55. 00 feet,
more or less, to the Northwest corner of the parcel described in
the Deed to the State of California recorded in the office of the
County Recorder September 30, 1958 in Book 578 of Official
Records at page 275, Shasta County Records; thence, along the
Westerly line of said state parcel, South 8 °00 '20" East to a
point which bears North 89°28 '27" East from the point of
beginning; thence, South 89°28 '27" West to the point of
