A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING PROGRAM SUPPLEMENT NO. 022/REV. 1 DATED AUGUST 11 ,
1989 , TO THE LOCAL AGENCY-STATE AGREEMENT FOR FEDERAL-AID
PROJECTS NUMBERED 02-5068 , ENTERED INTO BY AND BETWEEN THE
CITY OF REDDING AND THE STATE OF CALIFORNIA, DEPARTMENT OF
TRANSPORTATION, ON NOVEMBER 21 , 1977 , THE PURPOSE OF SAID
SUPPLEMENT BEING THE UPGRADE OF TRAFFIC SIGNAL CONTROLLER
UNITS IN THE DOWNTOWN AREA, AND AUTHORIZING THE MAYOR TO
SIGN SAID SUPPLEMENT.

IT IS HEREBY RESOLVED by the City Council of the City of
Redding as follows :
1 . That the City Council of the City of Redding hereby
approves the above-mentioned Program Supplement No. 022/Rev. 1
dated August 11 , 1989 , a true copy of which is attached hereto
and incorporated herein.
2 . That the Mayor of the City of Redding is hereby
authorized and directed to sign said Program Supplement on behalf
of the City Council of the City of Redding; and the City Clerk is
hereby authorized and directed to attest the signature of the
Mayor and to impress the official seal of the City of Redding on
the aforesaid Supplement, when appropriate.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 19th day of September , 1989 , and was
duly adopted at said meeting by the following vote:

This Program Supplement is hereby incorporated into the Local Agency-State 11
Agreement for Federal Aid which was entered into between the Local Agency and
the State on 11/21/77 and is subject to all the terms and conditions thereof'.
This Program Supplement is adopted in accordance with Paragraph 2 of Article.
II II of the aforementioned Master Agreement under authority of Resolution No.
;I , approved by the Local Agency on (See copy attached)' .
The Local Agency further stipulates that as a condition to payment of funds ,
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages. :4

SPECIAL COVENANTS OR REMARKS it
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will
be performed by the Local Agency at regular intervals or
as required for efficient operation of the completed
improvements.

2. The Local Agency will reimburse the State for their share of
costs for work requested to be performed by the State.
3. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal-Aid Project Agreement (PR-2)/
Detail Estimate or its modification (PR-2A) or the FNM-76,
and accepts any increases in Exchange Funds, State Matching
funds, and/or Local Agency funds as shown on the Finance or
Bid Letter or its modification as prepared by the Division
of Local Streets and Roads.
4. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Program.
5. Whenever the Local Agency uses Federal or State Funds to pay
a consultant on a cost plus basis, the Local Agency is
required to submit a post audit report covering the allow-
ability of cost payments for each individual consultant or
subcontractor incurring over $25,000 on the project. The
audit report must state the applicable cost principles
utilized by the auditor in determining allowable costs as
referenced in CFR 48, Part 31, Contract Cost Principles.
6. The State will advertise, award, administer and provide a
Resident Engineer for this project.
