A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
FINDING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF AN EASEMENT OVER A CERTAIN PARCEL OF REAL
PROPERTY FOR PUBLIC IMPROVEMENTS, NAMELY A DRAINAGE AND
TEMPORARY CONSTRUCTION EASEMENT FOR THE CALABOOSE CREEK
CHANNEL IMPROVEMENT PROJECT, THE OWNERS OF WHICH ARE GEORGE
C. AND BONITA J. RUSSELL.
BE IT RESOLVED by the City Council of. the City of Redding as
follows :
Section 1 . The City Council of the City of Redding finds
and determines that public convenience and necessity require the
extension by the City of Redding of public improvements, to wit,
a drainage and temporary construction easement for the Calaboose
Creek Channel Improvement Project, and that Government Code
Section 37350 . 5 authorizes the City to acquire the necessary
easement over the real property interests for said public
improvements by eminent domain.
Section 2 . The City Council finds and determines that the
subject project has been planned and is to be located in the
manner that will be most compatible with the greatest public good
and the least private injury.
Section 3 . In compliance with California Environmental
Quality Act requirements, the City Council ratified the Negative
Declaration for this Project, finding that there is no signifi-
cant impact on the environment.
Section 4 . The City Council also finds and determines that
the acquisition of the necessary easement over the property
interests depicted in Exhibit "A" and the sketch attached hereto,
situate in the City of Redding, County of Shasta, State of
California, are necessary for the construction and maintenance of
the aforesaid public improvements, and that the taking of said
easement over the property interests is necessary therefor.

Section 5 . The City Attorney of the City of Redding is
hereby authorized, empowered, and directed to perform as follows-
a. Commence an action or actions in eminent domain in the
Superior Court of the State of California, County of
Shasta, in the name of the City of Redding to acquire
the necessary easement over the property interests.
b. To incur in the name of the City of Redding, and on
behalf thereof, all obligations and expenses necessary
to acquire the above-mentioned easement over the
property interests.
Section 6 . The City Clerk of the City of Redding is hereby
directed to cause a certified copy of this Resolution to be

I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 15th day of August 1989 , and was duly
adopted at said meeting by a four-fifths vote as follows:

That real property situate in the City of Redding, County of Shasta, State of California,
described as follows:
An easement for drainage purposes over the southwesterly 20.00 feet of the following

Parcel 1:
Beginning at the Northeast corner of Block 22 of the Olivia Addition to the town (now
City) of Redding, as per Land Survey entitled "A Re-Survey of Blocks 22 and 23 of Olivia
Addition to Redding, for the purposes of showing boundary lines of same: surveyed by
Nicolas Zogg, Land Surveyor and filed December 12, 1934 in Book 5 of Land Surveys,
page 5; thence from the Northeast corner of said Block 22 run Westerly along the

boundary line between Block 22 and the Southerly line of Locust Avenue, 100 feet; thence
Southerly and parallel with the Easterly line of said Block 22 to the Boundary Line
between Blocks 22 nd 25 of said Olivia. Addition; thence Easterly, 100 feet along said
Boundary Line to the Southeast corner of said Block 22; thence Northerly along the
Boundary Line between Blocks 21 and 22 of said Olivia Addition to the point of
beginning.
Parcel 2:
All that portion of Block 22 of the Olivia Addition to Redding described as follows:
Commencing at the Northeast corner of said Block 22 as shown on the map recorded
December 12, 1934 in Book 5 of Land Survey at Page 5, Shasta County Records; thence
along the Southerly line of Locust Street, Westerly 100.00 feet; thence parallel with the
Westerly line of said Block 22, Southerly 184.00 feet to the true point of beginning of this
description; thence continuing parallel with said Westerly line, Southerly, 150.00 feet to the
Southerly line of said Block 22; thence along said Southerly line, Westerly 8.00 feet;
thence Northerly in a straight line to the true point of beginning.
TOGETHER WITH a temporary construction easement over the northeasterly 3.00 feet
of the southwesterly 23.00 feet of the above-described parcels.
