A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ESTABLISHING AND ADOPTING A POLICY STATEMENT PERTAINING TO ADMINISTRATIVE FEES FOR ESTABLISHING LANDSCAPE MAINTENANCE DISTRICTS. ► WHEREAS , the City Council of the City of Redding is charged with the responsibility of establishing municipal policies to guide the various functions of the City, and, where necessary, to establish procedures by which functions are performed; and WHEREAS, regulatory policies established by the City Council are usually adopted by Ordinance and included in the Municipal Code. However, other policies are also established, which by their nature do not require adoption by Ordinance; these policy statements , adopted. by Resolution of the City Council, need to be consolidated in a reference document for easy access; and WHEREAS, on August 4 , 1987 , by Resolution No. 87-261 , the City Council adopted a Council Policy Manual to achieve said objectives; and WHEREAS , City Council wishes to establish a policy statement pertaining to administrative fees for establishing landscape maintenance districts , which policy is set forth in Exhibit "A" attached hereto and incorporated herein by reference; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows : 1 . That all of the above recitals are true and correct; Ii • • 2 . That attached hereto as Exhibit "A" and incorporated herein by reference is a policy statement to be incorporated in the Council Policy Manual pertaining to administrative fees for establishing landscape maintenance districts. 3 . That the Council Policy attached hereto as Exhibit "A" be and hereby is adopted as the Council Policy of the City of Redding pertaining to administrative fees for establishing landscape maintenance districts. HAYS , City Attorney -2- CI'r OF REDDING, CALIFORNIA COUNCIL POLICY SUBJECT POLICY EFFECTIVE LANDSCAPE MAINTENANCE DISTRICTS - NUMBER DATE PAGE IFORMATION COSTS i, I 8-1-89 '' BACKGROUND The City of Redding requires the formation of landscape-maintenance districts ;� in conjunction with subdivisions which are located on the City' s arterial street system. These developments are required to install landscaping within the public right-of-way, including all associated improvements such as irrigation systems and automatic valve controls. The maintenance districts are ithereafter responsible for the yearly maintenance of the landscaping. The , V issue is: Should administrative costs attributable to the formation of I' 'I' landscape-maintenancedistricts be paid by the developer. ,r III PURPOSE 1 i It is the purpose of this l policy to clearly delineate whether subdivision developers will be required to pay an administrative fee upon making application for the formation of a landscape-maintenance district. POLICY It shall be the policy of the City of Redding that the developer(s) of jj subdivisions, where landscape-maintenance districts are required to be formed �! I ill as a condition of subdivision approval , shall pay an administrative fee equal i . to the total direct and indirect costs directly attributable to formation of j the district. Administrative costs associated with the ongoing operation of 1 the district shall be included in the yearly assessment on each lot in the i! district. `I PROCEDURE, 1 Upon requesting the formation of a landscape-maintenance district, the ! develo developer shall be required to pl; p q pay a fee commensurate with the administrative °` costs of establishing said district.
