IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows : 1 . That the City Council of the City of Redding hereby approves the Consultation Agreement between the City of Redding and the Shasta County Women' s Refuge for the period July 1 , 1989 , through June 30 , 1990 , a true copy of which is attached hereto and incorporated herein. 2 . That the City Manager of the City of Redding is hereby authorized and directed to sign said Agreement on behalf of the City Council of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding on the aforesaid document, when appropriate. HAYS, C ty Attorney 442 �II AGREEMENT THIS AGREEMENT is made and entered into this 16th day of June, 1989 , by and between the CITY OF REDDING, a Municipal Corporation and General Law City, hereinafter called "City, " and SHASTA COUNTY WOMEN' S REFUGE, hereinafter called "SCWR" : WITNESSETH: WHEREAS, it is the desire of City' s Police Department (hereinafter called "RPD") to have professional consultants available to render rape crisis intervention services to victims needing such assistance; and WHEREAS, SCWR is an organization especially qualified for such rape crisis intervention, with counselors possessing special training and experience in this field; and WHEREAS, it has been determined that this matter is not subject to the provisions of the California Environmental Quality Act; NOW, THEREFORE, IT IS AGREED by and between the parties hereto as follows: 1 . The term of this Agreement shall be for one (1) year, commencing July 1 , 1989 , and terminating June 30 , 1990 . 2 . SCWR shall remain on call 24 hours a day during the term of this Agreement, and when called by the RPD will report as Ij quickly as possible, but in no event later than one hour after being contacted by the RPD. 6'' 1 - I 3 . All SCWR Counselors assigned to work with the RPD shall i meet the qualifications listed in the Client Services Coordinator Job Title attached hereto as Exhibit "A" and incorporated herein �' I by reference. i 4 . All SCWR Counselors assigned to work with the RPD are required to attend an orientation meeting with the Crimes Against Persons Investigators and the Investigations Unit Supervisor. 5 . SCWR covenants and agrees that all of its Counselors +, will agree to accept and package the Sexual Assault Kit evidence � according to Department of Justice procedures. I I 6 . SCWR will only charge City for Counselor time spent for evidence collection, victim interviews, followup interviews at 'i the request of an investigator, and Court appearances, as i. ji necessary. I i� 7 . SCWR will be compensated by City for rendering such aid to victims at the rate of Ten Dollars ($10 .00) per hour, with a P minimum of two (2) hours per call-out, payable by City upon i receipt of SCWR' s billing approved by the Chief of Police. 8 . In the performance of this Agreement, SCWR and its Counselors are independent contractors of professional counseling services, and not employees of City. 9 . This Agreement is granted upon the express condition that City, its officers, agents, and employees, shall be free from any and all liability and claims for damages for personal in ur death or J Y. property damage in any way connected with SCWR' s services under this Agreement, including claims of SCWR, -2- Iy.I • II its officers , agents, employees, and counselors. SCWR shall I indemnify and save harmless City, its officers, agents, and GI employees, from any and all liability, loss, cost, or obligation on account of or arising out of any such injury, death, or loss caused by the negligence or other legal fault of SCWR or its officers, agents, employees, and counselors. 10 . It is understood and agreed as a condition of this Agreement that SCWR shall, at its own expense and at all times during the term of this Agreement, obtain from a company authorized to do business in the State of California and keep in full force and effect comprehensive general liability insurance in the minimum amount of $500 ,000 .00 combined single limits. Said policy shall name City, its officers, agents, and employees, as additional insured, and shall further contain a provision obligating the insurance carrier to notify City in writing at least ten (10) days prior to any cancellation or reduction of such insurance. A Certificate of Insurance evidencing such coverage and notice requirement shall be approved by the Risk Manager of City and filed with him prior to the commencement of I i this Agreement. 11 . It is further understood and agreed as a condition of this Agreement that SCWR will provide workers ' compensation insurance on its employees/counselors, and furnish the Risk Manager of City with a Certificate evidencing such insurance, to be approved by him. Said Certificate shall contain a provision obligating the insurance carrier to notify City in writing at -3- fl 410 III least ten (10) days prior to any cancellation or reduction of such insurance. 12 . Either party hereto may cancel this Agreement by giving thirty (30) days ' notice in writing to the other party of its intention to do so. 13. Any notices or demands that may be given by either party hereunder, including notice of default and notice of I I termination, shall be deemed to have been fully and properly given when made in writing, enclosed in a sealed envelope, and deposited in the United States Post Office, certified mail, postage prepaid, addressed as follows: To City c/o Chief of Police, City of Redding, 1313 California Street, Redding, California 96001 ; and to SCWR at Post Office Box 4211 , Redding, California 96099-4211 . HAYS, City Attorney a' I I, I -4- 111 SHASTA COUNTY WOMEN'S REFUGE Job Title: Client Services Coordinator Salary & Benefits: $ 6.92 per hour and benefits as defined in SCWR personnel policy. Scope: The Client Services Coordinator is responsible to the Executive Director for overall coordination and implementation of the client services program. This includes accompaniment, advocacy, short term crisis counseling, follow-up, support groups and compliance with Sexual Assault and Domestic Violence Assistance grants. S p.ervisor: Executive Director DuLre-s 1. Coordinate and delegate client services implemented 'by staff and volunteers. 2. Set up a client services program manual for sexual assault and domestic violence assistance. 3. Maintain adequate documentation as necessary for compliance with grant and funding source regulations. 4. Present written documentation to Crisis Line Coordinator on performance of crisis line workers. 5. Develop and maintain consistent communication and effective working relationships with associated organizations including maintaining current letters of agreement with each organization in compliance with grants.' 6. Maintain and annually update counseling referral list and implement portions of-counselor and crisis line trainings. 7 . Provide direct crisis line and back-up services or other related tasks as assigned by the Executive Director. Document services provided in compliance with program manual and grants. 8. Coordinate clients ' evaluation 'of services received. 9. Attend staff meetings and other meetings as assigned. 10. Supervise Volunteer and Crisis Line Coordinator delegating tasks as necessary. 11. Coordinate and implement professional trainings , i .e. law enforcement, district attorney, hospital/medical , counselor, and provide follow-up documentation in compliance with grant requirements. 12. Coordinate information and referral services including the completion of necessary documentation in compliance with funding source regulations. Qualifications: 1 . B.A. or B.S. degree in human service field. 2. Two years experience providing victim services , case management, or crisis counseling required. 3. Additional comparable experience may be substituted for educational requirement. 4. Knowledge of rape trauma syndrome, dynamics of sexual assault, -child abuse, domestic violence preferred. 5. Willingness and ability to complete 40 hour crisis line training and 8 hours per year of continuing education. 6.
