U 7-3.4 / V144.7 * , rZRO PA F ...... , .(/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING FORMATION OF TERRITORY INTO A LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT, AND AUTHORIZING THE LEVY AND COLLECTION OF ASSESSMENTS THEREIN PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 . LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 3 RESOLVED, by the City Council of the City of Redding that: WHEREAS , on November 14 , 1988 , Petitions and Consents for the Formation of Territory into a Landscaping and Lighting Assessment District and to the Levy and Collection of Assessments Therein Pursuant to the Landscaping and Lighting Act of 1972 signed by the owner (s) of the land as shown on the last equalized County assessment roll, or entitled to be shown as owner (s) on the next County assessment roll, or, where any of said property is subject to a recorded written agreement of sale, are shown therein as purchaser (s) , of all of the territory more particularly hereinafter described, were filed with with the City Clerk of the City of Redding, pursuant to the Landscaping and Lighting Act of 1972 , Division 15 , Part 2 (commencing with Section 22500) , of the Streets and Highways Code of the State of California, and especially Section 22608 . 1 thereof; and WHEREAS, said Petitions and Consents consented to said Council' s conduct of said proceedings without notice and hearing 11 and without the filing of an Engineer' s Report, all in accordance with said Act and especially Section 22608 . 1 thereof; and WHEREAS, proof satisfactory to Council of such Consents by the owner (s) of the property within said territory, together with an Engineer' s Report (although waived) , has been filed with the City Clerk of City; ca c� Q9OK• /� 9f rtitt;E 62 bo pa 5 - .)- i - : gv 4IP I NOW, THEREFORE, IT IS FOUND, DETERMINED, and ORDERED as follows: • 1 . Said Petitions and Consents for the Formation of Territory into a Landscaping and Lighting Assessment District and to the Levy and Collection of Assessments Therein Pursuant to the Landscaping and Lighting Act of 1972 were signed by the owner (s) of the land as shown on the last equalized County assessment roll, or entitled to be shown as owner (s) on the next County assessment roll, or, where any of said property is subject to a recorded written agreement of sale, are shown therein as purchaser (s) . yi 2 . The territory proposed to be formed into a landscaping i' and lighting assessment district is described as follows: All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1 through 60 inclusive of the Candlewood Subdivision, Unit 1 (APN 077-29-02) . 3 . The formation of said territory into a landscaping and lighting assessment district and the authority of this Council to levy and collect assessments therein pursuant to said Act are hereby approved without notice and hearing, pursuant to Section 22608 . 1 of said Act. 4 . That the report of the Engineer (although waived) , on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the proposed district, and the proposed assessments upon assessable lots { within the proposed district. Said Report is hereby approved by Council. 5 . Said territory be and hereby is ordered formed into a landscaping and lighting assessment district for the installation or construction of improvements and the maintenance or servicing, or both, thereof, together with any and all incidental expenses in connection therewith, all as more particularly authorized -2- . 4110 4100 pursuant to said Act, and shall hereafter be designated as "LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 3 , " by which name it shall hereafter be referred to in all subsequent proceedings , including proceedings for the levy and collection of assessments. 6 . That proceedings shall be taken by this Council pursuant to said Act for any fiscal year during which an assessment is to be levied and collected within said District. 7 . That a public hearing will be held on Tuesday, April 4 , 1989 , at the hour of 7 :00 p.m. , or as soon thereafter as the matter may be heard, at the City Council Chambers located at 1313 California Street, Redding, California, to address the levying of the proposed assessment for the fiscal year 1989-90 . 8 . The City Clerk of the City of Redding is hereby authorized and directed to file a certified copy of this Resolution, together with a map of said District, with the County Auditor of Shasta County.
