� RESOLUTION ORDERING CHANGE OF PROCEEDINGS TO
AUTHORIZE INCREASE IN ASSESSMENT NOS. 11, 12 & 17 IN ;
LUCKY LANE SEWER ASSESSMENT DISTRICT NO. 1988-1 �

The City Council of the City of Redding resolves:

'!� 1. Pursuant to Chapter 4.5 (Sections 10350 and following) of
the California Streets and Highways Code, on January 3, 1989, this
Council adopted its Resolution No. 89-12, Resolution of Intention _
to Order Change of Proceedings to Increase Assessment Nos. 11, 12 &
17. The reason for the proposed increases in the three subject j
assessments is to provide additional funds with which to discharge ,
a prior lien upon each of the three parcels. Each of said prior
' liens is delinquent, and the present owners of each of the three ;
parcels have failed to cure said delinquencies after mailed notice i
from the City advising that the assessment in these present
proceedings would be increased for the purpose of both curing such
delinquencies and, furthermore, fully discharging the lien on said
parcels in the event that any property owner did not make the
required reinstatement payment. As of the date of this public
hearing, none of the owners of the three respective parcels has
made the required payment.
2 . By its Resolution No. 89-12 entitled, "Resolution of
Intention to Order Change of Proceedings to Increase Assessment
Nos. 11, 12 & 17" , this Council fixed Tuesday, February 7, 1989, at
7 p.m. , or as soon as thereafter as the matter can be heard, in the
Council Chambers of the Redding City Council as the date, time and
place for a public hearing to consider the respective increases of
these three assessments. Notice of said hearing was given by
i certified first class mail, postage prepaid, and return receipt
� requested.

�I 3 . A Certificate of Mailing notice of hearing, demonstrating
+ actual receipt of such mailed notice by each of the three owners,
"i has been prepared by Olivia Elderts and is on file with the City '
�' Clerk in these proceedings. Attached to said Certificate of
; Mailing are copies of the respective notices, together with the
executed receipts.

4 . Prior to the February 7 public hearing, the City
Treasurer confirmed that the delinquencies respecting Assessment '
No. 12 had been reinstated, with the result that the proposed � �
N increase in Assessment No. 12 should be deleted from the �
� recommended action. �

' S. Pursuant to Section 10352 of the California Streets and
� Highways Code, this Council hereby orders the respective increases
� in the three assessments to the new increased amounts as follows:

� The Director of Public Works of the City of Redding is �
� ' hereby authorized and directed to make appropriate changes to the
��' Amended Engineer's Report previously approved in these proceedings �
� by this City Council. '

�, 6. This Council hereby directs the City Clerk to cause the
� preparation and recording of the amended Notice of Assessment in
� the Office of the Shasta County Recorder to reflect these increased �
iassessment amounts. I

I HEREBY CERTIFY that the foregoing resolution was
�I duly and regularly adopted by the City Council of the City of
� Redding, Shasta County, California, at a regular meeting thereof, I
held on the 7th day of February, 1989.
