U I�"��~ I f A RESOLUTION OF TH� CITY COUNCIL OF THE CITY OF REDDING � APPROVING THE LETTER AGREEMENT DATED JArdUARY 12 , 1989 , NO. ; 89-SAO-10014 , WITH THE DEPARTMENT OF ENERGY, WESTERN AREA � � POWFR ADMINISTRATION, ALLOWING REDDING TO EXCEED ITS ; CONTRACTUAL CAPACITY LIMIT OF 160 MVA AT THE KESWICK �" SUBSTATION UNTIL CONSTRUCTION OF THE AIRPORT SUBSTATION IS j" COMPLETED, AND ALJTHORIZING THE CITY MANAGER TO SIGN SAME. � I � I { WHFREAS , the present contractual 1�_mitation for the delivery � of power to the City through Western' s Keswick Substation is 160 ' i MVA, as stipulated in Article 25 of Supplement No. 1 to Contract � ' No. DE-MS65-83WP59008 ; and i � WHEREAS, the Electric Department currently projects that the i ; City' s 1989 summer peak load may exceed 160 MVA; and � ��; WHEREAS, in anticipation of the City' s load exceeding 160 � MVA, construction has begun on the Airp�rt Substation, which will '� increase the limitation on power deliveries through Western' s �; ' transmission system to a minimum of 275 MVA; and � � WHEREAS, it is not expected that the Airport Substati�n will ��i ` be operational before the peak load or.curs in 1989 ; and � ��I WHEREAS, b�� the attached Letter Agreement, Western will ii allow Redding to exceed the 160 MVA capacity limit at the Keswick ip Substation under certain conditions; and WHEREAS, said Letter Agreement will be in effect only until City has completed construction of its Airport Substation sometime in the summer of 1989 ; and ' WHEREAS , the Electric Department and the Electric Utility Commission recommend approval of the Letter Agreement; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of � the City of Redding that: �, � i � ��4 �'' � � ' � �� i �il l . � � I I I� �, II I I ` 1 . By ietter dated December 12, 1988, the City of Redding (Redding) has informed 'i, the l�lestern Area Power Administration (b�estern) that it may exceed the 1� � capacity limitation at the Keswick Substation (160 MVA) stipulated in Article I " i 25 of Supplement No. l, Contract No. DE-MS65-83WP59008. The completion of the � iconstruction of Redding's Airport Substation will alleviate this potential I � condition in the summer of 1989. Western is willing to allow Redding to i . exceed the 160 MVA capacity limit under the following conditions: I;�, , 1. Redding's load in excess of 160 MVA shall not impair electrical service � N�' to Shasta Dam Area Public Utility District (Shasta) or jeopardize �i! Western's transmission system, particularly the facilities at Keswick. j ,, , ,,, 2. If, in the sole determination of Western ' s Dispatch Office (lJDO) , � �, Redding's load in excess of 160 MVA creates or will imminently create an ;i, overloaded system element or other physical problem in Western's � u, transmission system, or impairs or will imminently impair service to ; Shasta, then Redding will , following notification from Western's WDO, : " curtail its load in excess of 160 MVA in such amount and during such ; '� periods as will be sufficient to eliminate, or eliminate the potential t of, such overload, problem or impairment, as determined by WDO. ; �;, i � � 3. If Western determines that Redding is responsible for damages to �i Western's transmission facilities or that Shasta received impaired , service as a result of Redding's noncompliance with Condition 2, above, ,i then Redding will compensate Western for any such damages to its �i � facilities and shall indemnify and hold Western harmless from any loss or damage and from any liability on account of personal injury, death, or i ��;! property damage, or claims for personal injury, death, or property damage , f of any nature whatsoever and by whomsoever made arising out of or as a ! , � result of such impaired service to Shasta. In addition, Redding shall � II�� indemnify and hold Western harmless from any loss or damage and from any � �� liability on account of personal injury, death, or property damage, or claims for personal injury, death, or property damage of any nature � � � � i � i b,'� E • • � • I � � ��hatsoever and by whomsoever made arising out of or as a result of any curtailments made by Redding or Western in accordance with Paragraph 2, above. 4. This agreement shall not be construed to create any rights for persons "i not a party hereto. �� I ' S. This agreement shall be in effect from the date of execution and remain „ ; � ' in effect until the in-service date of Redding's Airport Substation.
