The City Council of the City of Redding does hereby ordain as follows: Section 1 . Title 2 , ADMINISTRATION AND PERSONNEL, of the Redding Municipal Code is hereby amended by adding a new Chapter 2 . 42 as follows: Chapter 2.42 RIVER AND WATERWAYS COMMISSION Sections: 2 . 42. 010 Established 2 . 42. 020 Members - Appointment - Terms - Vacancies 2. 42.030 Members - Advisory 2. 42 .040 Members - Removal 2. 42 . 050 Members - Compensation 2 . 42 . 060 Officers 2. 42 . 070 Meetings - Time 2 . 42 . 080 Meetings - Special 2. 42 . 090 Meetings - Place - Quorum 2 . 42. 100 Duties. 2 . 42 . 010 Established. There is created and established a City commission which is named "River and Waterways Commission, " and which is referred to in this chapter as the "Commission. " The Commission shall serve for eight years, unless renewed by the City Council. It shall act in an advisory capacity to the City Council. � w li I 0 2 . 42 . 020 Members - Appointment - Terms - Vacancies. The Commission shall consist of seven members who shall be residents of the City of Redding. All members shall be selected based upon their qualifications by reason of their knowledge and experience by the Mayor, with and subject to the approval of the City Council. The term of office of all members so appointed shall be four years except for initial appointments and except if a vacancy shall occur for any reason other than the expiration of the term of that member' s office, it shall be filled by appointment by the Mayor, with and subject to the approval of the City Council for the unexpired portion of the term of the member whose office is vacated. Initial appointments shall be made as follows: two members shall be appointed for two years; two members shall be appointed for three years; three members shall be appointed for four years. Subsequent appointments shall be for the regular time as set forth in this section. 2. 42. 030 . Members - Advisory. The Council member appointed by the City Council as liaison to the Commission and the Director of the Planning and Community Development Department shall be advisory members of the Commission. They shall have no vote, and they shall not be considered members for purposes of constituting a quorum. Their terms of office as advisory members shall correspond in tenure to their official tenure as officials of the City. Advisory members may designate an appropriate deputy from staff to attend meetings of the Commission in their place and stead on such occasions as their other duties may prevent them from sitting in attendance at particular Commission meetings. 2 . 42 . 040. Members - Removal. Any appointed member of the Commission may be removed by the City Council. Any appointed member of the Commission who fails to attend four consecutive meetings of the Commission without permission from the City Council to be absent shall be considered automatically removed and a vacancy shall be deemed to have occurred unless good cause is shown. The City Council shall be the sole judge as to whether or not good cause is shown; and when it is determined that good cause has not been shown, then the vacancy so created shall be filled immediately by the Mayor, with and subject to the approval of the City Council, for the unexpired portion of the term. 2 . 42 . 050 . Members - Compensation. All appointed members of the Commission shall serve as members without compensation. -2- Y I 4 2 . 42 . 060 . Officers. There shall be two officers in the Commission: a Chairman and a Vice Chairman. An advisory member of the Commission may not hold .11 the office of Chairman or of Vice Chairman. The Planning and Community Development Director, or a duly designated subordinate, shall be Secretary to the Commission. The Commission shall elect its officers at the first regular meeting of the Commission in May of each year, and they shall hold office for a term of one year. Any vacancy in any of the offices shall be filled by the Commission at the first regular meeting of the Commission after the vacancy occurs and shall be filled for the unexpired portion of the term of office to be filled. The Chairman shall preside at all meetings of the Commission, and in the Chairman' s absence the Vice Chairman shall preside. The Secretary shall make and keep a record of all resolutions, transactions, findings, and determinations of the Commission, and shall record and keep the Minutes of the Commission meetings. 2 . 42 . 070 . Meetings - Time. The Commission shall meet at two p.m. on the second Thursday of each and every month, except when that day falls on a legal holiday, in which case the meeting shall be held on the day following the holiday, and the meeting shall be a regular meeting of the Commission. The Commission may adjourn any regular meeting of the Commission from time to time or place to place so long as the adjournment shall not extend to a point in time beyond the day of the next regular meeting of the Commission. 2 . 42. 080. Meetings - Special. To call a special meeting, the Chairman or a majority of the members shall file with the Secretary of the Commission, at least twenty-four hours prior to the date the meeting is to be held, a signed written notice of the meeting, which notice shall specify it the time and place of the special meeting and the agenda therefor. The signed written notice shall also be served personally or by certified mail upon all members of the Commission who did not sign the notice of the special meeting. Twenty-four hour notification shall also be given in writing to all newspapers, radio stations, and television stations which have filed a request for notification in writing with the City Clerk or the Secretary of the Commission. The presence of all members at the special meeting, or the waiver of notice in writing by any absent members , shall constitute a waiver of the requirement of notice as it relates to members. 2 . 42 . 090. Meetings - Place - Quorum. ' I Regular meetings shall be held in the City Council chambers. Adjourned regular meetings, special meetings, and regular meetings -3- r I_ • when deemed necessary may be held elsewhere within the City, II' provided notice of the time and place of the meetings and of the agenda of special meetings is given to all members of the 61 Commission and to all newspapers, radio stations, and television stations which have filed a request for notice in writing with the City Clerk or with the Secretary of the Commission. A majority of the members of the Commission shall constitute a quorum for the transaction of business at any regular or special meeting of the Commission. h ' li 2 . 42 . 100 . Duties. The River and Waterways Commission shall have the following duties and responsibilities: A. To act as an advisory body to the City Council and make recommendations to the City Council regarding river and waterway uses, policies, and Ordinances; "iB. To make recommendations regarding programs or proposals which may facilitate public awareness, public participation, and public education with regard to safe and responsible utilization of the Sacramento River and other waterways; C. To make recommendations regarding sanitation, litter Ili abatement, commercial uses, special events, licenses, permits , fees, collections , and funding; D. Recommend political action to the City Council on river, fishery, boating, and riparian habitat measures ; and '^ E. Recommend coordination of activities with other 1 Commissions, departments, or agencies. Section 2. It has been determined that this matter is categorically exempt from the provisions of the California g Y Environmental Quality Act. Section 3 . The City Clerk shall certify to the adoption of this Ordinance and cause its publication according to law.
