Redding, CA. 96001 SEP 27 199 0 RESOLUTION NO. 90-398 4")"14-11100 ASSESSOR-RECORDER FEE ��� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF THE WISCONSIN AVENUE STREET RIGHT-OF-WAY LOCATED WEST OF BUENAVENTURA BOULEVARD AND NORTH OF LAKESIDE DRIVE (A-6-90) . WHEREAS , proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways , and Service Easements Vacation Law, Streets and Highways Code i; Section 8300 , et seq. ; and WHEREAS , the City Council of the City of Redding finds and determines that, subject to the conditions set forth below, the hereinafter described real property is not necessary for present or prospective street right-of-way purposes; NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders as follows : 1 . City Council makes the following findings in connection herewith: (a) The project is compatible with the Redding General Plan; (b) The project will not significantly alter the existing land form; (c) The project is compatible with the surrounding land use; and (d) The project is compatible with the Redding Municipal Code. 2 . That certain real property in the City of Redding, County of Shasta, State of California, being a portion of the Wisconsin Avenue street right-of-way located west of Buenaventura Boulevard and north of Lakeside Drive, as the same is more particularly described in Exhibit "A" and the maps attached hereto and incorporated herein by reference, be and the same is B002646PAGE62 it , 41/ III . hereby vacated and abandoned as a street right-of-way, SUBJECT TO the following conditions : (a) That portion of right-of-way necessary for the extension of Waushara Avenue easterly to connect with Lakeside Drive, as shown in the attached map, shall be retained. (b) A public-service easement on the easterly 47 .5 feet of the 80-foot-wide alignment of Wisconsin Avenue shall be retained for storm-drain improvements associated with Lakeside Drive and for the existing 8-inch sewer line in the center of the Wisconsin Avenue alignment. (c) At the time further subdivision of Lot 2 of LS-12-85 , curb, gutter, sidewalk, and street paving shall be constructed across the frontage of the parcel, including all of the vacated area. 3 . HAYS City Attorney •,i -2- BOOK2646 PAGE 628 EXHIBIT "A" A-6-90 That certain real property situate , lying, and being in the City of Redding, County of Shasta, State of California , more parti- cularly described as follows : That certain 5 ' public service easement shown on that certain Map filed for record in Book 25 of Parcel Maps at pace 21 , Shasta County Records , lying westerly and adjacent to the westerly right-of-way line of Wisconsin Avenue and northerly of the north line of the 20 ' dedication as shown on said Map; TOGETHER WITH that certain portion of Lot 2 as shown on said Map and lying within the boundaries of Wisconsin Avenue ; 1 AND RESERVING THEREFROM the easterly 47 . 5 ' for sewer and storm drain purposes as measured perpendicular to the centerline of I ' Wisconsin Avenue and the southerly 25 ' for road and public service purposes .
