HomeMy WebLinkAboutReso 1990-299 - Approving and authorizing the mayor to execute supplememt No. 025 RESOLUTION NO. .4/Q 02p1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE SUPPLEMENT NO. 025 , REV. 1 , DATED MAY 25 , 1990 , TO LOCAL AGENCY-STATE AGREEMENT FOR FEDERAL-AID PROJECTS NO. 02-5068 , PROJECT NO. HES-5273 (010) , ON QUARTZ HILL ROAD AT THE INTERSECTION OF STATE HIGHWAY 273 . BE IT RESOLVED by the City Council of the City of Redding as follows: 1 . That the City Council of the City of Redding hereby approves Supplement No. 025 , Rev. 1 , dated May 25 , 1990 , to Local Agency-State Agreement for Federal-Aid Projects No. 02-5068 , Project No. HES-5273 (010) , on Quartz Hill Road at the inter- section of State Highway 273 for traffic signals and lighting, a true copy of which is attached hereto and incorporated herein by reference. 2 . That the Mayor of the City of Redding is hereby authorized and directed to sign Supplement 025 , Rev. 1 , on behalf of the City of. Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. Number: 02-450904 FOR FEDERAL-AID PROJECTS NO. 02-5068 This Program Supplement is hereby incorporated into the Local Agency-State Agreement for Federal Aid which was entered into between the Local Agency and the State on 07/05/77 and is subject to all the terms and conditions thereof. jl This Program Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. , approved by the Local Agency on (See copy attached). This Revised Program Supplement supersedes Program Supplement approved by the Local Agency' s Governing Body on 03/01/90. 2 . All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency and/or the respective agencies as ' 1 determined by agreement at regular intervals or as required for efficient operation of the completed improvements. 3 . The Local Agency will advertise, award, and administer this project and will obtain the State' s concurrence prior to either award or rejection of the contract. 4 . The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR-2A) or the FNM-76, and accepts it any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 5. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances ' contained in the aforementioned Master Agreement for 1 ; Federal-Aid Program. 6. Whenever the local agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25, 000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
