HomeMy WebLinkAboutReso 1990-271 - Accepting from the united states ownership a surplus 8" waterline in the keswick dam road 410 RESOLUTION NO. 4/12" 7/ rl A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ACCEPTING FROM THE UNITED STATES OWNERSHIP OF A SURPLUS 8" WATERLINE IN THE KESWICK DAM ROAD, EXTENDING WEST OF THE INTERSECTION OF KESWICK DAM/QUARTZ HILL ROAD TO KESWICK DAM. WHEREAS, certain real property owned by the United States , IIS located in the County of Shasta, State of California, has been declared surplus and is subject to assignment for disposal for public health purposes by 203 (k) (1) of the Federal Property and I I Administrative Services Act of 1949 , as amended, and rules and regulations promulgated pursuant thereto, namely a surplus eight I.' II inch (8" ) Water Line in the Keswick Dam Road, extending West of the intersection of Keswick Dam/Quartz Hill Road to Keswick Dam (property) ; and WHEREAS, the City of Redding needs and can utilize said property for public health purposes in accordance with the requirements of said Act, and the rules and regulations promul- gated thereunder, of which this Council is fully informed, including commitments regarding use and time within which such I IIuse shall commence; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows : II I; N Ir • 1 . That the City of Redding shall make application to the Secretary of Health and Human Services for and secure the transfer to it of the above-mentioned property for said use upon and subject to such exceptions, reservations , terms , covenants, agreements, conditions , and restrictions as the Secretary of I Health and Human Services, or his/her authorized representative, may require in connection with the disposal of said property under said Act, and the rules and regulations issued pursuant thereto. 2 . That the City of Redding has legal authority, is willing, and is in a position financially and otherwise to assume immediate care and maintenance of the property, and that the Mayor of the City of Redding is hereby authorized, for and on behalf of the City of Redding, to do and perform any and all acts and things which may be necessary to carry out the foregoing Resolution, including the preparing, making, and filing of plans, applications, reports , and other documents; the execution, acceptance, delivery, and recordation of agreements, deeds , and other instruments pertaining to the transfer of said property; and the payment of any and all sums necessary on account of the purchase price thereof, including fees or costs incurred in connection with the transfer of said property for surveys, title searches, appraisals , recordation of instruments, or escrow it -2- r^ I s • • ' I costs, together with any payments by virtue of nonuse or deferral of use of the property.
