A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE CITY'S INTEREST IN THE RIGHT OF WAY
AND EASEMENT FOR WATER LINE PURPOSES RECORDED ON JUNE 9,
1970 IN BOOK 1030, PAGE 384 SHASTA COUNTY RECORDS
(ABANDONMENT APPLICATION A-2021-01276)
WHEREAS:
A. The 15 -foot -wide Right of Way and Easement for water line purposes being considered for
summary vacation was acquired by the recordation of the Deed of Right of Way on June 9, 1970
in book 1030, page 384, Shasta County records and is described in Exhibit "A" and shown on
Exhibit "B" attached and made a part hereof by reference.
B. There are no public facilities within the Right of Way and Easement and therefore may be
determined to be excess and eligible for summary vacation.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS
FOLLOWS:
The City Council elects to proceed in this matter under the provisions of the California Streets
and Highways Code, Section 8333.
The City Council approves the request to summarily vacate the Right of Way and Easement as
described in Exhibit "A" and shown hatched on Exhibit `B."
The Right of Way and Easement being vacated is considered excess; therefore, from and after the
date this Resolution is recorded, the Right of Way and Easement described in Exhibit "A" and
shown on Exhibit `B," shall be vacated in its entirety and longer constitutes an easement for
public purposes.
