HomeMy WebLinkAboutReso 1990-240 - Involving tax transfeers between the ceterville community services district i RESOLUTION NO. 90•21710 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING INVOLVING TAX TRANSFERS BETWEEN THE CENTERVILLE COMMUNITY SERVICES DISTRICT AND THE CITY OF REDDING FOR THE CENTERVILLE C.S.D. REORGANIZATION NO. 90-1 (WESTSIDE ESTATES/RIDGEVIEW SUBDIVISIONS) . BE IT RESOLVED by the City Council of the City of Redding as follows: WHEREAS, Assembly Bill 8 (Chapter 282) Statutes 1979, as subsequently amended, provides for any County Board of Supervisors or the Board of Directors of any special district and any affected city to determine an appropriate property tax transfer for all jurisdictional changes of organization or reorganization occurring within County prior to the proposal being considered by the Local Agency Formation Commission (LAFCO); and WHEREAS, the current distribution of property taxes for the affected properties within the affected tax rate areas 001-037 and 001-157 is as follows: AREA TO BE ANNEXED AREA TO BE DETACHED APN 81-330-51 A Portion of APN 81-330-56 (Westside Estates Subdivision) (Ridgeview Subdivision) 15.35% City of Redding's share 9.05% City of Redding's share 0.25% Centerville CSD's share 7.00% Centerville CSD's share 84.40% Non affected agencies share 83.95% Non affected agencies share 100.00% Total 100.00% Total and WHEREAS, Senate Bill 180 (Chapter 801) requires that non affected local agencies percentage share will remain constant; and WHEREAS, the affected local agencies have a combined tax apportionment factor in the annexation of the Westside Estates Subdivision of 15.60% and in the detachment of the Ridgeview Subdivision of 16.05% which is subject to negotiation for a tax exchange as a result of the proposed change of organization or reorganization; and \o - 1 - �v a ' iI,I • _ • a WHEREAS, the Centerville Community Services District and the City of Redding wish to agree to a fair share distribution of remaining property tax 1 revenues. NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Centerville Community Services District does hereby agree to the following I i formula for property tax distribution within the affected areas after the change of organization or reorganization including modifications to the reorganization area that are approved by LAFCO: AREA TO BE ANNEXED APN 81-330-51 (Westside Estates) 1. Base Tax Revenue: .1 A. "Base year tax" as defined in Revenue & Taxation Code shall be distributed as follows: (1) To the District, 45.6% of the base year tax allocated to the City in the fiscal year of the reorganization. (2) To the City, 54.4% of the base year tax allocated to the City in the fiscal year of the reorganization. 1 2. Annual Tax Increment Revenue: Annual tax increment as defined in Revenue & Taxation Code resulting from increases in assessed valuation over the base year valuations shall be distributed between the District and the City on the basis of 45.6% to the District and 54.4% to the City. AREA TO BE DETACHED A Portion of APN 81-330-56 (Ridgeview Subdivision) 1. Base Tax Revenue: A. "Base year tax" as defined in Revenue & Taxation Code shall be distributed as follows: (1) To the District, 0% of the base year tax allocated to the City and District in the fiscal year of the reorganization on that portion of the area subject to boundary change. (2) To the City of Redding, 100% of the base year tax allocated to the City and District in the fiscal year of the reorganization on that portion of the area subject to the boundary change. - 2 - it • 2. Annual Tax Increment Revenue: Annual tax increment as defined in Revenue & Taxation Code resulting from increases in assessed valuation over the base year valuations shall be distributed between the District and the City on the basis of 0% to the District and 100% to the City on that portion of the area subject to the boundary change. BE IT FURTHER RESOLVED that the City Clerk of the City of Redding is authorized and directed to file a certified copy of this resolution, along I with appropriate fees, with the Executive Officer of the Local Agency Formation Commission of Shasta County.
