HomeMy WebLinkAboutReso 1990-216 - Approving and adopting a road impact • I'� RESOLUTION NO. 9(2.2/4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND ADOPTING A ROAD IMPACT FEE FOR THE DANA DRIVE TRAFFIC IMPACT FEE DISTRICT, PURSUANT TO CHAPTER 16.43 OF THE REDDING MUNICIPAL CODE. 11 WHEREAS, on March 20, 1990, City Council adopted Ordinance No. 1914 establishing the Dana Drive TrafFir Impact Fee District, and enacting a new Chapter 16.43 of the Redding Municipal Code; and 1 WHEREAS, Section 16.43.060 states that a Road Impact Fee shall be established in the manner and amount set forth in a Resolution adopted by the City Council pursuant to said Ordinance; ,i NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves and adopts a Road Impact Fee for the I Dana Drive Traffic Impact Fee District, as follows: ql Computation of the Amount of Road Impact Fee: I A. At the option of the feepayer, the amount of the Road Impact Fee may ' be determined by the following fee schedule: Fee Schedule Residential per Living Unit Single Family $952.70 Multiple Unit 647.99 Hotel/Motel per Room 740.00 Commerr_ial per square foot of floor area 3.74 Office/General per square foot of floor area 2.31 Service Industrial per square foot of floor area .50. 1. If a building permit is requested for mixed uses, then the fee shall be determined through using the applicable schedule by apportioning the space committed to uses specified on the applicable schedule. For applications for an extension of a building or an extension of a permit for mobilehome installation, the amount of the fee is the difference between that fee then applicable and any amount already paid pursuant to this Resolution. 3. If the type of development activity that a building permit is applied for is not specified on the applicable fee schedule, the Planning Director shall use the fee applicable to the most nearly comparable type of land use on the fee schedule. The Planning Director shall be guided in the selection of a comparable type by the Report titled Trip Generation: An Information Report (4th Edition) , prepared by the Institute of Transportation Engineers. If the Planning Director determines that there is no comparable type of land use on the applicable fee schedule, then the Planning Director shall determine the fcc by: a. Using traffic-generation statistics provided by Caltrans or contained in a Report titled Trip Generation: An Information li Report (4th Edition) , prepared by the Institute of Transportation Engineers. b. Applying the formula set forth in the Fee Schedule contained in paragraph A hereof. c. Reducing the fee so determined by the appropriate percentage as indicated in paragraph A above. 4. In the case of change of use, redevelopment, or expansion or modification of an existing use which requires the issuance of a 11 building permit or permit for mobilehome installation, the impact fce shall be based upon the net positive increase in the impact fee for the new use as compared to the previous use. The Planning Director shall be guided in this determination by traffic--generation statistics provided by the Report titled Trip Generation: An Information Report (4th Edition) , prepared by the Institute of Transportation Engineers. B. If a feepayer opts not to have the impact fee determined according to paragraph A of this Resolution, then the feepayer shall prepare and submit to the Planning Director, together with a $300 project-review fee, an independent fee calculation study for the land development activity for which a building permit or permit for mobilehome installation is Ij sought. The traffic engineering and/or economic documentation II submitted shall show the basis upon which the independent fee calculation was made, including, but not limited to, the following: 111 1 1. Traffic Engineering Studies: 11 HI -2- I '�' ` I`41 • • a. Documentation of trip-generation rates appropriate for the proposed land development activity. b. Documentation of trip length appropriate for the proposed land 111 development activity. c. Documentation of any other trip data appropriate for the proposed land development activity. iI 2. Economic Documentation Studies: a. Documentation of the cost per land per mile for roadway construction appropriate for proposed land development activity. b. Documentation of credits attributable to the proposed land development activity and other capital improvements deemed required to mitigate impacts of development. Independent fee calculation studies shall be prepared and presented by professionals qualified in their respective fields. All traffic engineering I studies submitted must be prepared by a registered Traffic Engineer. Construction cost studies shall be submitted by a registered Civil Engineer. The Planning Director shall consider the documentation submitted by the feepayer, but is not required to accept such documen- 1 tation as he or she shall reasonably deem to be inaccurate or not reliable and may, in the alternative, require the feepayer to submit additional or rj different documentation for consideration. If an acceptable independent fee calculation study is not presented, the feepayer shall pay road impact fees based upon the Fee Schedule shown in paragraph A of this Resolution. Determinations made by the Planning Director pursuant to this paragraph may be appealed to the Planning Commission by filing a written request with the Planning Director within ten (10) days of the ii City Manager's determination. ti Upon acceptance of an independent fee calculation study, the following formula shall be used by the Planning Director to determine the impact fee per unit of development: Number of Vehicle Trips x Percent New Trips x $92.57 per trip end = Impact Fee.
