RESOLUTION NO. 762 -19. 3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING THAT AN EMERGENCY SITUATION EXISTS; AUTHORIZING
THE BYPASS OF THE FORMAL BIDDING PROCESS; AWARDING A
CONTRACT TO TOTER, INC. (SINGLE VENDOR) FOR THE PURCHASE OF
AUTOMATED REFUSE CONTAINERS; AND AUTHORIZING THE CITY
MANAGER TO SIGN THE NECESSARY DOCUMENTATION.
WHEREAS, as part of the 1989-90 Equipment Lease Program,
Council approved the purchase of approximately 8 , 600 automated
refuse containers from Toter, Inc. for residential collection;
and
WHEREAS, from this original purchase , 650 containers were
kept in reserve for new customers and requests for second
containers, which staff felt would serve the City' s needs through
fiscal year 1989-90 ; and
WHEREAS , during the past two months, deliveries to new
services and second-container requests have averaged 30 per week;
and
WHEREAS, at this rate, the remaining 100 reserve containers
will be depleted by May 25 , 1990 ; and
WHEREAS, delivery of one truckload (405 automated refuse
containers) is needed as soon as possible to replenish reserves
and fill requests until the 1990-91 budget; and
WHEREAS , delivery can be expected within four to six weeks
from Council approval; and

WHEREAS , in order to standardize the City' s automated refuse
containers to the highest quality possible, it is necessary to
purchase the containers from a single vendor, Toter, Inc. , at
$58 . 50 per container, for a total cost of approximately
$25 , 800 .00 ; and
WHEREAS , revenue to cover these costs is generated from the
$8 monthly residential garbage rate and the $3 monthly rate for
additional containers; and
WHEREAS , pursuant to Redding Municipal Code Section
4 . 20 . 080 A. 1 and 2 , staff recommends that a contract be awarded
to Toter, Inc. for said containers , in the amount of $25 ,800 .00 ;
and
WHEREAS , the City Council has carefully studied the afore-
said matter, and has determined that said recommendation is in
the best interests of the City; and
WHEREAS , it has been determined that this matter is categor-
ically exempt from the provisions of the California Environmental
Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Redding as follows:
1 . That the foregoing recitals are true and correct.
2 . That, pursuant to Redding Municipal Code Section
4 . 20 . 080 A. 1 and 2 , the formal bidding process be bypassed, and
a contract awarded to Toter, Inc. in the amount of $25 ,800 . 00 for
the purchase of automated refuse containers.

3 . That the City Manager is hereby authorized and directed
to execute the necessary documentation on behalf of the City of
Redding, and the City Clerk is hereby authorized to attest the
signature of the City Manager and to affix the seal to the
documentation when appropriate.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 1st day of May , 1990 , and was duly
adopted at said meeting by the following 4/5ths vote of Council:
