HomeMy WebLinkAboutReso 1990-181 - Amending Agreement pertaining to the use of the property located at 1072 lake boulevard III I RESOLUTION NO. 90 -131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE AMENDED AGREEMENT PERTAINING TO THE USE OF THE PROPERTY LOCATED AT 1072 LAKE BOULEVARD, REDDING, CALIFORNIA, BETWEEN THE CITY OF REDDING AND RICHARD E. ROWAN, DEVELOPER, AND AUTHORIZING THE MAYOR TO SIGN. BE IT RESOLVED that the City Council of the City of Redding hereby approves the Amended Agreement Pertaining to the Use of the Property Located at 1072 Lake Boulevard, Redding, California, entered into between the City of Redding and Richard E. Rowan, Developer, a true copy of which is attached hereto and incorpo- rated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Amended Agreement on behalf of the City Council of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding. HAYS , City Attorney \, • • AGREEMENT PERTAINING TO THE USE OF THE PROPERTY LOCATED AT 1072 LAKE BOULEVARD, REDDING, CALIFORNIA THIS AMENDED AGREEMENT, made and entered into this day of 1990, by and between the CITY OF REDDING, a municipal corporation, hereinafter referred to as "City," and Richard E. Rowan, hereinafter referred to as "Developer:" WITNESSETH: WHEREAS, Developer has request reclassification of the property described in Exhibit "A" and shown as Exhibit "B" in order to develop a mini-warehouse project and convenience store; and WHEREAS, Developer proposes to develop mini-warehouse storage and a 9,000-square-foot retail center; NOW, THEREFORE, BE IT RESOLVED that the parties agree to all of the following: 1 . City agrees to reclassify the 2.66-acre area shown on Exhibit "A" from "Residential, 3.0 units per acre" to "Service Commercial" on the Redding General Plan in order to accommodate development of mini-warehouse storage and retail center, as described above. 2. In the event the mini-warehouse storage or retail center is not constructed within two years of the effective date of the ordinance reclassifying the land to "Service Commercial;" the land will automatically revert back to "Residential, 3.0 units per acre" and the property shall be rezoned "R1-ST-B10." The City shall initiate the rezoning in the event that any development permit application is submitted for uses other than those described herein. 3. All necessary permits will be obtained and prepaid prior to development of the properties in accordance with the Redding City Code. Permits are to include a conditional use permit. building permit, and encroachment permit. Also, a grading permit is to be obtained if necessary. 4. City retains the right to amend the General Plan and zoning of this area at any time pursuant to the procedure in the Redding Municipal Code and in accordance with the Redding Municipal Code and in accordance with the Redding General Plan and any such change will automatically void this agreement. • • IN WITNESS WHEREOF the parties hereto have set their hands and seals on the day and year first above written.
