A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING AN AGREEMENT IN PRINCIPLE BETWEEN THE CITY OF
REDDING AND THE U.S . BUREAU OF RECLAMATION RE THE SPRING
CREEK PUMPED STORAGE PROJECT, AND AUTHORIZING THE MAYOR TO
SIGN.
WHEREAS , the proposed Spring Creek Pumped Storage Project
will pump and return water from and to the Keswick Reservoir,
which is owned and operated by the U.S. Bureau of Reclamation
(USBR) ; and
WHEREAS, an Agreement in Principle with the USBR is
necessary in order to demonstrate to the Federal Energy
Regulatory Commission (FERC) that the USBR agrees to the City' s
use of the Keswick Reservoir, and to form the basis for
negotiations for a final construction/operating agreement with
the USBR;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of
the City of Redding as follows :
1 . That the City Council of the City of Redding hereby
approves the Agreement in Principle between the City of Redding
and the U.S. Bureau of Reclamation, a copy of which is attached
hereto and incorporated herein.
2 . That the Mayor of the City of Redding is hereby
authorized and directed to sign said Agreement on behalf of the
City of Redding, and the City Clerk is hereby authorized and

directed to attest the signature of the Mayor and to impress the
official seal of the City of Redding.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 2nd day of January , 1990 , and was
duly adopted at said meeting by the following vote:

AGREEMENT IN PRINCIPLE
BETWEEN
THE CITY OF REDDING, CALIFORNIA
AND
THE U.S. BUREAU OF RECLAMATION
WHEREAS , the City of Redding (Redding) holds a preliminary permit
issued by the Federal Energy Regulatory Commission for Project
#8499 , the 100 megawatt (MW) Spring Creek Pumped Storage Project;
and
WHEREAS, Redding proposes to use a portion of the capacity of the
Keswick Reservoir to operate the proposed Spring Creek Pumped
Storage Project; and
WHEREAS, the United States owns and the Bureau of Reclamation
(USBR) operates Keswick Reservoir as part of the Central Valley
Project (CVP) ; and
WHEREAS, the United States owns and USBR operates three hydro-
power facilities (Shasta, Keswick, and Spring Creek) which may be
affected by Redding' s use of Keswick Reservoir for the Spring
Creek Pumped Storage Project; and
WHEREAS, preliminary studies conducted by both Redding and the
United States indicate that increasing the present capacity of
Keswick Reservoir up to a total of approximately 25 , 700 acre feet
to accommodate CVP power needs, is technically feasible; and
WHEREAS, 2 , 310 acre feet of the increased capacity in Keswick
Reservoir can normally be made available for use by Redding in
connection with the operation of the Spring Creek Pumped Storage
Project without interfering with CVP operations under the
following principles . Therefore, the United States and Redding
declare their Agreement in Principle to the following:
1 . USBR will increase the capacity of the Keswick Reservoir to
approximately 25 , 700 acre feet by the following:
a. adding flashboards and modifying the Keswick spillway
gates , hoists , and appurtenant equipment as neces-
sary.
b. modify the Spring Creek Hydropower Plant facilities
as necessary.
2 . The USBR will allow Redding, upon full compliance with the
National Environmental Policy Act requirements , to construct
and operate the Spring Creek Pumped Storage Project and to
use up to 2 , 310 acre feet of capacity in Keswick Reservoir,

subject to the restrictions described in paragraph 8 , provided
that:
a. detailed design studies confirm the technical fea-
sibility of increasing the capacity of Keswick
Reservoir, and
b. Redding obtains a Federal Energy Regulatory Commis-
sion hydropower license for the project and decides
to proceed with the project.
3 . Redding will advance to USBR pursuant to the Contributed
Funds Act, the amount of funds necessary to finance the
total cost of all modifications or improvements to the USBR
facilities , including the reservoir shoreline, required to
increase the capacity of Keswick Reservoir.
4 . USBR agrees to credit in whole, or in part to the use fee
described in paragraph 5 the funds advanced pursuant to
paragraph 3 above , plus appropriate interest in the manner
to be determined by the Secretary of the Interior.
5 . Redding agrees to pay the United States a reasonable use fee
as determined by the Secretary of the Interior for use of up
to 2 , 310 acre feet per year of capacity in Keswick Reservoir
in connection with the operation of the Spring Creek Pumped
Storage Project. In addition to a capital component, it is
anticipated that the use fee will include an operation and
maintenance component.
6 . Redding will pay for the acquisition, installation,
modification, and replacement of all the equipment needed
for the monitoring, scheduling and coordinated operation of
the Spring Creek Pumped Storage Project with Shasta, Spring
Creek, and Keswick facilities .
7 . Redding will compensate the United States for the loss of
electric energy and capacity from the USBR generation units
at Shasta, Spring Creek, and Keswick due to operation of the
Spring Creek Pumped Storage Project, by providing return
energy and capacity. Return energy and capacity will be
provided on a real-time basis coincident with the time of
lost generation from the USBR units , unless the United
States and Redding mutually agree to alternative quantities
of energy, time, and rate of delivery (capacity) of the
return energy.
8 . USBR and Redding will enter into an agreement for the opera-
tion of the Spring Creek Pumped Storage Project in conjunc-
tion with Keswick Reservoir, to ensure such operation will
have no adverse impact on the authorized and prudent opera-
tion of USER facilities and the mission of the USSR' s CVP.
That agreement will provide, among other things , that during

emergency conditions, Redding will modify operations of the
Spring Creek Pumped Storage Project facilities as directed
by USBR. Redding shall hold the United States harmless for
any impacts such modified operations have on the Spring
Creek Pumped Storage Project and the City of Redding.
Such emergency conditions shall include, but not be limited to:
(i) when unregulated inflow to Keswick Reservoir and
downstream flow objectives for flood control require
a reduction or complete shut-down of all regulated
inflows to Keswick Reservoir;
(ii) when mandatory flood control releases from Shasta
Reservoir require a reduction or complete shut-down.

(iii) when additionalreleases are being made to dilute
releases and/or spills from Spring Creek Debris Dam;
(iv) when operation of Spring Creek Pumped Storage Project
would have an adverse impact on temperatures in the
Sacramento River; and
(v) emergency power conditions.
9 . Prior to the start of construction for the Spring Creek
Pumped Storage Project, this Agreement in Principle will be
replaced by one or more final agreements between Redding and
the United States . Execution of the final agreement (s)
shall be preceded by the preparation of appropriate
documentation under the National Environmental Policy Act,
which documentation shall address , at a minimum:
a. the principles discussed in this Agreement,
b. final detailed design drawings and calculations for
the Spring Creek Pumped Storage Project,
c. the operating agreement with the USBR, and
d. the terms and conditions of the Federal Energy Regu-
latory Commission license.
