Home My WebLink About2006 - Amending Redding Mynicipal Code Chapter 16.04 11/ 110 ORDINANCE NO. 2006 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE CHAPTER 16.04, BUILDING OFFICIAL—PERMITS, AND SECTION 16.42.040, TIME OF PAYMENT OF CONSTRUCTION TAXES. The City Council of the City of Redding does hereby ordain as follows: Section 1. That Redding Municipal Code Chapter 16 .04 be amended by repealing the entire Chapter, and adding the following Chapter 16 . 04: Chapter 16.04 BUILDING OFFICIAL—PERMITS Sections: 16.04.010 Enforcement Duties 16.04.020 Fee Payment 16.04.030 Building Permits Issued by a Public Agency Other Than the City 16.04.040 Disposition of Fees. 16.04.010 Enforcement Duties. The Building Official shall be charged with the enforcement of the City' s Building Codes as adopted by City Council or required to be enforced by mandate of the state or federal governments. 16.04.020 Fee Payment. All permit, plan check, energy check, code enforcement, inspection fees, and book or publication charges required to be paid by applicant shall be remitted directly to the City Treasurer by the applicant for the permit, certificate, plan review, inspection, publication, or service. No inspection, plan review, or certificate shall be performed or issued unless the fees () have been paid. �,. 410 16.04.030 Building Permits Issued by a Public Agency Other Than City. Permits for construction, remodeling, or installation of structures, including mobile or modular units, within the City by another agency that do not require the Building Division to do plan review, perform inspections, or issue a certificate of occupancy, completion, or compliance shall not be charged a fee for those services; however, a building permit shall be obtained to collect other fees imposed by the City, to assure adequate fire flows during and after construction, and to coordinate connection or service from City utilities. Fees associated with such permit for other than Building Division related services shall be due and payable prior to any construction or installation of such services. 16.04.040 Disposition of Fees. All fees collected due to Building Division activities and submitted to the City Treasurer shall be credited to the appropriate accounts established by this Code, or by Resolution of City Council. Section 2. That Redding Municipal Code Chapter 16. 42, Construction Taxes, be amended by repealing Section 16 . 42 . 040 , and adding the following Section 16. 42 . 040 : 16.42.040 Time of Payment. The construction tax required in this Chapter to be paid shall be due and payable upon issuance of a building permit, or upon issuance of a permit to construct and install electrical and plumbing equipment to service a mobilehome lot in a mobilehome park; actual payment of such tax may be deferred until no later thanthe time of final inspection of the work permitted. Section 3. It has been determined that this matter is categorically exempt from the provisions of the California Environmental Quality Act. Section 3. The City Clerk shall certify to the adoption of this Ordinance and cause its publication according to law.
