HomeMy WebLinkAboutMinutes - City Council - 03-16-21 - Regular347 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 March 16, 2021, 6:00 PM Due to the increase in the spread of Covid-19 and the latest directives from the Governor and the California Department of Public Health, the Mayor modified access to the City Council meeting to enable members of the public to make public comments with the following requirements: (a) entry to the Council Chambers was limited to members of the public wishing to address the Council on any agenda item; (b) people who wished to speak to the City Council checked -in with City staff at the Community Room door beginning at 5:45 p.m.; (c) speakers waited outside the building until time for the Council to hear the item. City staff assembled the speakers and admitted up to four people into the Council Chambers at any one time. If more than four people wished to address an item, they were admitted following the comments from the first four speakers; (d) all members of the public were asked to wear a face mask, however, they could remove the mask while speaking; (e) speakers were given up to three (3) minutes to address the Council and after speaking, the individual left the building following the directional arrows and exited through the main chamber doors. The meeting was called to order by Mayor Erin Resner with the following Council Members present: Michael Dacquisto, Mark Mezzano, Kristen Schreder, and Julie Winter. Also present were: City Manager Barry Tippin, Assistant City Manager Sheri DeMaagd, City Attorney Barry DeWalt, City Clerk Pamela Mize, Assistant City Clerk Anette Cates, and Executive Assistant Luisa Klapperich. The Pledge of Allegiance to the Flag was led by Mayor Resner. The Invocation was provided by Reverend Janet Chapman, First Christian Church — (Disciples of Christ). PUBLIC COMMENT Bill Gilbert spoke regarding City of Redding Building Code violations. Mark Gunlogson spoke regarding Accessory Dwelling Unit compliance issues. Steve Furman spoke on having issues obtaining welfare checks for family members and also noted that staff at the City Library are continually rude to him. Robert Seago spoke on speeding and reckless vehicular behavior on Redwood Blvd, even after speed bumps were installed. Nick Gardner expressed concern regarding the homeless population and use of campfires in undesignated areas. Lowell Herried noted that he feels he has not been treated fairly by City staff and requested assistance from Council Members. Lyle Van Norman notes that there has been unnecessary harassment and fines to the elderly in his neighborhood from appliance inspector. 03/16/2021 348 CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes: Special Meeting — Closed Session of March 2, 2021; and Regular Meeting of March 2, 2021. 4(b). Accept Accounts Payable Register No. 16; and Payroll Register No. 17. (1) Accounts Payable Register No. 116 for the period of February 13, 2021, through February 26, 2021 for a total of $9,552,131.53, for check numbers 160946 through 161246, inclusive, ACH transfer numbers 16831 through 16882, inclusive, Wire Transfer numbers 10400 through 10410, inclusive; and (2) Payroll Register No. 17 for the period of February 7, 2021 through February 20, 2021 for a total of $3,221,923.93, for electronic deposit transaction numbers 528768 through 529656, inclusive, and check numbers 606827 through 606859. SUMMARY TOTAL: $12,774,055.46. 4.1(a). Accept report and make a determination by a four-fifths (4/5ths) affirmative vote that conditions of local emergency continue to exist within the City of Redding, under Public Contract Code section 22050(c)(1) related to the Coronavirus (COVID-19). 4.1(b). Authorize the City Manager to negotiate Purchase and Sale Agreements (PSA) with T and S DVBE, Inc. relative to property owned by the City of Redding (City) located at 4855 and 4950 Venture Parkway, Parcels 1 and 2 (Assessor's Parcel Numbers 054- 830-001, 054-830-002, and 054-830-003) in Stillwater Business Park for fair market value; authorize the Mayor to sign the PSAs and any other documents needed to complete the sale and transfer ownership of the property; and find the sale of the property by the City is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA Guidelines (Surplus Government Property Sales). 4.1(c). Authorize staff to administratively make adjustments to the Redding Electric Utility (REU) Wildfire Prevention and Improved Response Program portion of the REU Wildfire Mitigation Plan to improve delivery of needed services to the community. Adjustments will include but not necessarily be limited to staff assignment, Memorandum of Understanding changes, and assignment of tasks. 4.2(a). Adopt Resolution No. 2021-037, a resolution of the City Council of the City of Redding, declaring April as Fair Housing Month in the City of Redding. 4.2(b). Adopt Resolution No. 2021-038, a resolution of the City Council of the City of Redding, rescinding and replacing Resolution No. 2020-002 for the Infill Infrastructure Grant (IIG) Program to assist with the development of the Lowden Lane Senior Apartments Project; and authorize the City Manager to execute the necessary IIG Program documents. 4.4(a). Accept the 2020 General Plan/Housing Element Annual Progress Report and direct staff to forward the document to the Governor's Office of Planning and Research, as well as the State Department of Housing and Community Development. 4.5(a). Authorize the purchase of two bucket trucks at a cost of $942,718 using Sourcewell contract pricing with Altec Industries, Inc., for use in transporting high voltage journeyman linemen into an elevated position to work on a portion of the electrical grid operated and maintained by the Redding Electric Utility. 4.5(b). Authorize the City Manager, or designee, to sole -source the procurement of software, hardware, and service agreements relating to Redding Electric Utility's operations as a Transmission Owner/Transmission Operator as recommended by the expert consultant assisting with implementation. 03/16/2021 349 4.11(a).Authorize the following actions relative to Bid Schedule No. 5189, Locust Lift Station and Force Main Project: (1) award to RTA Construction, Inc., in the amount of $919,160; (2) approve an additional $150,000 to cover the cost of administration and inspection fees and $191,500 for project development costs; (3) approve $91,900 to provide construction contingency funding; (4) authorize the City Manager to approve additional increases in either the construction management or construction contingency amounts up to a total of $50,000; and (5) find that the project is categorically exempt from review under the California Environmental Quality Act Guidelines Sections 15061 (Common Sense Exemption) and 15302 (Replacement or Reconstruction). 4.11(b).Authorize the following relative to the City of Redding's COVID-19 Economic Stimulus Package projects: (1) accept an update on project progress; and (2) ratify approval of the City Manager award for the Ball Field Lighting Upgrades at Buckeye Park and Caldwell Park Kiwanis 2, 3, and Soccer Field Project (C19 -LS -02) to Builders Solutions, Inc. in the amount of $303,485. 4.11(c).Adopt Resolution 2021-039, a resolution of the City Council of the City of Redding, summarily vacating an existing 15 foot -wide Public Service Easement within Parcel 1 as described within Book 3704 at page 563, Shasta County Records also known as APN 109-310-028; and find this action consistent with the General Plan and categorically exempt from environmental review under the California Environmental Quality Act per Section 15061 (Common Sense Exception). 4.11(e).Approve the purchase of one 2022, Autocar ACX64 Roll Off truck using Sourcewell contract pricing, with a net delivered cost of $262,586.68, including all applicable taxes and fees, for the City of Redding Solid Waste Utility. 4.11(f).Adopt Resolution 2021-040, a resolution of the City Council of the City of Redding, restricting parking to two hours for certain areas on Market Street between Tehama Street and Yuba Street, and on Butte and Yuba Streets between Market Street and Pine Street. 4.14(a). This item was moved to the Regular Calendar as item number 9.14(a) per request of Council Member Mezzano. 4.14(c). Authorize the City Attorney to amend the contract between the City of Redding and Liebert Cassidy Whitmore (C-8504) for legal services in the case of Wallace, et al. v. City of Redding (Shasta County Superior Court Case No. 194952), to bring the maximum compensation payable to three hundred twenty-five thousand dollars ($325,000.00). A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Winter, that the foregoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, authorized, and/or rescinded. Ordinance - Amending Redding Municipal Code (RMC) Title 7 (Animals) relating to the keeping of animals. Management Assistant to the City Manager Janelle Galbraith highlighted the Report to City Council (staff report), incorporated herein by reference. Presentation by Jake Mangas, President/CEO Chamber of Commerce, and Michael Warren, President/CEO Turtle Bay, providing an overview of the Redding Garden of Lights event held at the Turtle Bay Exploration Park McConnell Botanical Gardens from November 27, 2020, through December 31, 2020. In lieu of Michael Warren, Randall Hempling, Board Member of the Turtle Bay Exploration Park presented a PowerPoint presentation, incorporated herein by reference. The City Council took no formal action on this informational item. 03/16/2021 351 9.1(f). Mayor's flexibility in opening or closing Council meetings in accordance with the Blueprint for a Safer Economy Tier assigned to the County and within legal parameters. City Manager Tippin presented the Report to the City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Winter, seconded by Council Member Dacquisto, to authorize the Mayor flexibility in opening or closing Council meetings in accordance to the Blueprint for a Safer Economy Tier assigned to the County and within legal parameters. The Vote: Unanimous Ayes. 9.11(d).Oral update on the City of Redding Water Utility and the Bureau of Reclamation 2021 Water Supply Allocation. Assistant Director of Public Works Ryan Bailey provided an overview of the Report to City Council (staff report), and a PowerPoint presentation, both incorporated herein by reference. The City Council took no formal action on this informational item. 9.14(a).Moved Item No. 4.14(a) from Consent Calendar to Regular Calendar Item No. 9.14(a) at Council Member Mezzano 's request. Report regarding limiting local campaign finance limitations. City Attorney DeWalt highlighted the Report to the City Council (staff report), incorporated herein by reference. Council Member Dacquisto noted that there should be no limit on local contributions. Council Members Winter and Schreder supported limiting campaign contributions according to A13571; Government Code 85301 and 83124. It was the consensus of the Council that no action be taken on this item, thereby accepting the State's recommendation and the Fair Political Practice Commission guidelines regarding local campaign finance limitations. 9.14(b).Update relating to short-term rental owners' compliance in payment of Transient Occupancy Tax and an update regarding the utilization of software to monitor compliance with the short-term rental ordinance, Redding Municipal Code Section 18.43.180. City Attorney DeWalt summarized the report to City Council (staff report), incorporated herein by reference. The City Council took no formal action on this informational item.
