HomeMy WebLinkAboutReso 2021-077 - Declaring a shelter crisis pursuant to the Shelter Crisis Law (gov. code section 8698 et seq.)RESOLUTION NO. 2021-077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING A SHELTER CRISIS PURSUANT TO THE SHELTER CRISIS LAW (GOV. CODE SECTION 8698 ET SEQ.) WHEREAS, Government Code section 8698(d) provides that a "shelter crisis" is a situation in which a significant number of persons are without the ability to obtain shelter resulting in a threat to their health and safety; and WHEREAS, the 2020 Shasta County Point -in -Time Report provided that four hundred fifty-four (454) individuals within the City of Redding "("City"), including veterans, women, children, individuals with disabilities, senior citizens, and other vulnerable groups, are experiencing unsheltered homelessness within the City; and WHEREAS, many of those unable to obtain shelter reside on the streets, in alleys and doorways, along the Sacramento River and its tributaries, and in unlawful encampments throughout the City; and WHEREAS, these individuals lack adequate sanitary facilities and are at risk from theft, crime, and extreme weather conditions; and WHEREAS, these conditions threaten the health and safety of the unsheltered population and likewise threaten the public health and safety of the public at large, contribute to a draw on public resources, and threaten the environmental health of the City's waterways; and WHEREAS, a declaration of a "shelter crisis" provides flexibility to address the aforementioned conditions by suspending state laws which might otherwise hinder or delay a city's ability to address the effects of the shelter crisis; and WHEREAS, it is the intent of the City Council to limit the suspension of state law only to those areas and facilities granted a permit from the City Council to establish a emergency shelter site and that no suspension of state law shall result in any other area of the City by means of this resolution; and WHEREAS, the City Council finds that strict compliance with state statutes and regulations may prevent, hinder, or delay the mitigation of the effects of the shelter crisis; and WHEREAS, the City Council has adopted ordinances to permit the establishment of emergency shelter sites and facilities which will mitigate the effects of a shelter crisis; MW NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT: 90 6 1. The recitals set forth herein are true, correct, and are adopted as findings of fact. 1 2. A shelter crisis pursuant to Government Code section 8698 et seq. exists in the City of Redding and is hereby declared. The effective period of the shelter crisis shall commence on the effective date of Ordinance Nos. 2637 and 2638, and shall continue until such time that a resolution is adopted by the City Council terminating the shelter crisis. 4. This resolution shall not be construed as providing a property right or entitlement to any particular use of land during the duration of the shelter crisis. 5. The declaration of a shelter crisis accomplished by this resolution shall not result in the suspension of any state housing, health, habitability, planning and zoning, or safety standard or procedure established by State law in any area of the City not formally approved by resolution of the City Council in accord with the Redding Municipal Code as an emergency shelter site. 5. This resolution shall take effect on the date that Ordinance Nos. 2637 and 2638 are effective.
