RESOLUTION NO. 2021-072
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE CITY'S INTEREST IN A 5 -FOOT -WIDE
PUBLIC SERVICE EASEMENT WITHIN SILVERSTONE SUBDIVISION
UNIT 1 IN BOOK 25 OF MAPS AT PAGE 26, SHASTA COUNTY
RECORDS (ABANDONMENT APPLICATION A-2021-00960)
WHEREAS:
A. The 5 -foot -wide Public Service Easement being considered for summary vacation was
acquired by the recordation of Stonesfair Parcel Map PM -18-04 recorded on November
30, 2004 in book 35 of Parcel Maps at Page 80 Shasta County records and is described in
Exhibit "A" and shown on Exhibit `B" attached and made a part hereof by reference.
B. There are no public facilities within this Public Service Easement and therefore may be
determined to be excess and eligible for summary vacation.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate the Public Service Easement
as described in Exhibit "A" and shown hatched on Exhibit "B."
3. This portion of easement being vacated is considered excess; therefore, from and after the
date this Resolution is recorded, the Public Service Easement described in Exhibit "A" C
and shown on Exhibit `B," shall be vacated in its entirety and no longer constitutes an
easement for public purposes.
4. The vacation of this Public Service Easement is consistent with the General Plan and
qualifies as Categorically Exempt from environment review under the California
Environmental Quality Act Guidelines Section 15061. The easement was acquired by an
easement grant deed to the City for utility purposes. There are no environmental
attributes to the property underlying the storm drain easement which would merit
preparation of a mitigated negative declaration or environmental impact report. The
underlying property does not have significant values for wildlife habitat or other
environmental purposes and is of such size and shape that is incapable of independent
development or use. The property underlying the storm drain easement has not changed
since the time of its acquisition by the City. As such, there is no possibility that vacation
of the public service easement will have a significant impact on the environment.
5. The City Clerk is directed to cause a certified copy of this Resolution of Vacation,
attested by the Clerk under seal, to be recorded in the Office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY, that the foregoing resolution was introduced and adopted at a regular
meeting of the City Council of the City of Redding on the 15th day of June, 2021, by the
following vote:

California, more particularly described as follows:
All that portion of the 5 foot wide PSE "A" as shown on the Parcel Map recorded on
November 30, 2004 in Book 35 of Parcel Maps at Page 80, Shasta County Records that
falls Southerly of the Southerly line of Adjusted Parcel A per PLA -2019-00270 recorded
in Document No. 2019-0011630, Shasta County Records.
