HomeMy WebLinkAboutReso 2021-068 - Approving the report of the Engineer as filed and declaring its intentionRESOLUTION NO. 2021-068 LANDSCAPE MAINTENANCE DISTRICTS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED AND DECLARING ITS INTENTION TO: 1. SET A PUBLIC HEARING DATE REGARDING THE FOLLOWING LANDSCAPE MAINTENANCE DISTRICTS D, E, F, G, H, Hl, J, K, L, M, N, O, P, Q, R, S, S1, T, U, V, W, 01-06, 02-06, 03-06, 04-06, 05-06, 06-06, 07-06, 08- 06, 09-06,11-06, 01-07, 02-07, 02-09, 03-09, 01-11, 02-11, 03-11, 01-13, 02-14, 03- 14, 01-15, 02-16, 03-16, 01-17, 01-19, 02-19, AND 01-20. 2. LEVY AND COLLECT ASSESSMENTS IN THESE DISTRICTS FOR FISCAL YEAR 2021-22 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. 1`."/1 X�F:A A. The City Council heretofore ordered the consolidated formation of the Landscape Maintenance Districts under authority granted by the Landscaping and Lighting Act of 1972 as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of these Districts is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval for each District and the general locations as outlined in the table below. C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. D. This Resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22624. E. The assessments for Fiscal Year 2021-22 are not an increase within the meaning of Streets and Highways Code §22624 and 22630.5 because the cost of living adjustment provided for herein was approved at the time of the formation of the Districts. NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: 1. The matters set forth above are true, correct, and are adopted herein. 2. Pursuant to the Streets and Highways Code §22623, the Report of the Engineer as filed is hereby approved. 3. The Engineer's Reports, on file with the City Clerk, contain a full and detailed description of the improvements, the boundaries of the district and any zones therein, and the proposed assessments upon the assessable acres and remaining parcels within the districts. 4. The existing improvements for each subdivision in the Districts are set forth in Part B of the Engineer's Reports on file with the City Clerk. 5. The general locations of the acres and remaining parcels in the District are set forth in Part A of the Engineer's Reports on file with the City Clerk. 6. Only costs for the maintenance of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, removal of trimmings, rubbish, and debris, maintenance of the detention basin, and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. A public hearing will be held on Tuesday, July 20, 2021, at the hour of 6:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the confirmation and approval of the proposed assessment for Fiscal Year 2021-22. The proposed assessment for Fiscal Year 2021-22 is outlined in the table below, it being the intention of the Council to levy said assessment in the amount as also indicated in the table below for Fiscal Year 2021-22. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
