RESOLUTION NO.2021-041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE CITY'S INTEREST IN A PORTION OF
WALNUT AVENUE BETWEEN BUTTE STREET AND THE 20 FOOT WIDE
ALLEY WITHIN THE SOUTH HALF OF BLOCK K OF THE DAKYN ADDITION
TO THE TOWN OF REDDING,TOWN PLAT 32, SHASTA COUNTY RECORDS
(ABANDONMENT APPLICATION A-2020-01486)
WHEREAS:
A. The 60 foot wide portion of Walnut Avenue being considered for summary vacation was acquired
by implied dedication with the recordation of the Dakyn Addition to the Town of Redding filed as
Town Plat 32, Shasta County Records and is described in Exhibit "A" and shown on Exhibit"B"
attached and made a part hereof by reference.
B. This portion of Walnut Avenue has not been used for the purpose of which it was dedicated and
may be determined to be excess. The adjacent parcel owners have asked that the City vacate this
portion as described in Exhibit"A" and shown hatched on Exhibit"B"attached and made a party
hereof by reference.
C. The City is RETAINING a 28 foot wide public service easement as described in Exhibit"A" and
shown on Exhibit`B."
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS
FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California Streets and
Highways Code, Section 8300 et seq.

2. Pursuant to Streets and Highways Code 8334,the City Council determines this portion of Walnut
Avenue to be excess as is unnecessary for present or prospective public street use.

3. The City Council approves the request to summarily vacate this portion of Walnut Avenue bounded
on the South by Butte Street and on the North by the 20 foot wide alley within Block K of the
Dakyn Addition to the Town of Redding, Town Plat 32 as described in Exhibit"A"and shown on
the attached Exhibit`B."
4. The City reserves and excepts from this vacation,a 28 foot public-service easement for the purpose
of erecting,installing,constructing,removing,repairing,replacing,reconstructing,maintaining and
using for public-service purposes any and all materials, fixtures, appliances, equipment, pipes
pipelines,wires,and cables necessary for the transmission,distribution,and delivery of electricity,
water, sewer, storm water, gas, cable television, communication, and information service utilities
over,along,upon,under,and across the parcel of real property described in Exhibit"A"and shown
on Exhibit`B."
3. The vacation of this portion of Walnut Avenue is consistent with the General Plan and qualifies as
Categorically Exempt from environment review under the California Environmental Quality Act
Guidelines Section 15312 and 15061. The easement was acquired by dedication to the City for
street purposes. There are no environmental attributes to the property underlying the street which
would merit preparation of a mitigated negative declaration or environmental impact report. The
underlying property does not have significant values for wildlife habitat or other environmental
purposes and is of such size and shape that is incapable of independent development or use. The
property underlying the street has not changed since the time of its acquisition by the City. As
such, there is no possibility that vacation of the street will have a significant impact on the
environment.
4. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the
Clerk under seal,to be recorded in the Office of the Shasta County Assessor/Recorder.

the City Council of the City of Redding on the 6th day of April,2021, by the following vote:

SUMMARY VACTION
All that portion of land situate in the City of Redding, Shasta County, State of California,
more particularly described as follows:
All that portion of Walnut Avenue being 60.00 feet in width lying Northerly of the
Northerly line of Butte Street being 60.00 feet in width and lying Southerly of the
Southerly line of the 20.00 wide Alley as shown on that Record of Survey filed for record
in Book 31 of Land Surveys at Page 152, Shasta County Records.
RESERVING THEREFROM a 28.00 foot wide Public Service Easement for Utilities,the
centerline of which is more particularly described as follows:
Being the same as that centerline of Walnut Avenue lying Northerly of the Northerly line
of Butte Street being 60.00 feet in width and lying Southerly of the Southerly line of the
20.00 wide Alley as shown on that Record of Survey filed for record in Book 31 of Land
Surveys at Page 152, Shasta County Records.
