HomeMy WebLinkAboutReso 2021-038 - Rescind Reso 2020-002 and authorize submission of HUD Grant application RESOLUTION NO.2021-038 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING RESCINDING RESOLUTION NO. 2020-002 AND AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE INFILL INFRASTRUCTURE GRANT PROGRAM; AND ANY RELATED DOCUMENTS NECESSARY TO COMPLETE THE INFILL INFRASTRUCTURE GRANT PROGRAM APPLICATION WHEREAS,the City of Redding, a municipal corporation and general law city, desires to be aco-applicant with Central California Housing Corporation and the Community Action Agency of Butte County, to apply for an allocation of funds through the Infill Infrastructure Grant Program;and WHEREAS, the California Department of Housing and Community Development (HCD) has issued a Notice of Funding Availability (NOFA) for the Infill Infrastructure Grant Program established under the Housing and Emergency Shelter Trust Fund Act of 2006 (Proposition 1 C) pursuant to the Infill Infrastructure Grant Program established Part 12 of Division 31 of the Health and Safety Code, commencing with Section 53545.12. Pursuant to the statute, HCD is authorized to approve funding allocations utilizing monies made available by the State Legislature, subject to the terms and conditions of the statute and the Infill Infrastructure Grant Program Guidelines implemented October 30, 2019; and WHEREAS,the City of Redding, as a co-applicant with Central California Housing Corporation and the Community Action Agency of Butte County,wishes to submit an application to obtain from HCD an allocation of the Infill Infrastructure Grant Program funds in the amount not to exceed $5,000,000; and WHEREAS, the City Council of the City of Redding adopted Resolution 2020-002 on January 21, 2020, relating to the authority to apply for an IIG Program Application; and WHEREAS, the City Council now desires toe rescind Resolution 2020-002 and adopt this resolution instead; NOW, THEREFORE, BE IT RESOLVED THAT: 1. Resolution 2020-002 is hereby rescinded. Pro 2. The City of Redding, as a co-applicant with Central California Housing Corporation and the Community Action Agency of Butte County, shall submit to HCD an application to participate in the Infill Infrastructure Grant Program in response to the NOFA issued on October30, 2019 which will request a funding allocation not to exceed $5,000,000 for the following activities: site development costs, underground C' (N CC work, and frontage improvements to develop infrastructure to support a Qualifying Infill Project: Lowden Lane Senior Apartments. 3. If the application is approved, City of Redding, as a co-applicant with Central CaliforniaHousing Corporation and the Community Action Agency of Butte County, hereby agrees to usethe Infill Infrastructure Grant Program funds for eligible activities in the manner presented in theapplication as approved by HCD for participation in the Infill Infrastructure Grant Program. 4. That in connection with the Recipient's IIG Grant,the Recipient is authorized and directed to enter into, execute, and deliver a State of California Standard Agreement, and any and all other documents required or deemed necessary or appropriate to carry into effect the full intent and purpose of the above resolution, in order to evidence the IIG Grant, the Recipient's obligations related thereto, and the Department's security therefore; including, but not limited to, an affordable housing covenant, a performance deed of trust, a disbursement agreement, and certain other documents required by the Department as security for, evidence of or pertaining to the IIG Grant, and all amendments thereto (collectively, the "IIG Grant Documents"). 5. The City Manager, or his designee, is authorized to execute in the name of City of Redding as co-applicant with Central California Housing Corporation and the Community Action Agency of Butte County, for the Infill Infrastructure Grant Program application, and all other documents required by HCD for the Infill Infrastructure Grant Program, and all other documents required by HCD for execution of the IIG Grant Documents, and any amendment or modifications thereto, on behalf of the Recipient.
