HomeMy WebLinkAboutOrd 2071 - Amending RMC Ch 9.32, nuisances, by repealing section 9.32.040 in its entirety and adding a new section 9.32.040 enttitles Abatement-Nonresident or owner not to be found ORDINANCE NO. 020 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING REDDING MUNICIPAL CODE CHAPTER 9.32, NUISANCES, BY REPEALING SECTION 9.32.040 IN ITS ENTIRETY AND ADDING A NEW SECTION 9.32.040 ENTITLED ABATEMENT—NONRESIDENT OR OWNER NOT TO BE FOUND. The City Council of the City of Redding does hereby ordain as follows: Section 1. Chapter 9. 32, NUISANCES, of the Redding Municipal Code is hereby amended by repealing Section 9. 32. 040 in its entirety, and adding a new Section 9. 32. 040 as follows: 9.32.040 Abatement—Nonresident or Owner Not to be Found. A. Whenever a nuisance exists on any property within the City that is owned by a nonresident; or the owner thereof cannot be found by the health officer after a diligent search; or the owner, within three days after the receipt by him of due notice from the health officer, refuses or neglects to abate the nuisance: it shall be the duty of the health officer to cause the nuisance to at once be removed or abated, and such sums as may be required for the removal or abatement—not to exceed $500—shall be paid by the City. B. If it is found necessary to expend a larger sum for such removal or suppression, the City Council may, upon application of the health officer, appropriate, allow, and order paid out of the general fund such sums as may be necessary for that purpose. C. The sums so paid as provided in this chapter shall become a lien upon the land and premises on which the offense is committed, and may be recovered in an action against the property. The health officer shall keep an account of all such expenses, and shall certify it to the City Attorney. It shall be the duty of the City Attorney to foreclose all such liens in the proper Court, in the name of and for the benefit of the City; and when the property is sold, enough of the proceeds shall be paid into the City treasury to satisfy the lien. Section 2. It has been determined that this matter is categorically exempt from the provisions of the California Environmental Quality Act. Section 3. The City Clerk shall certify to the adoption of this Ordinance and cause its publication according to law.
