AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING
AMENDING TITLE 10, PUBLIC PEACE, MORALS, AND WELFARE, OF
THE REDDING MUNICIPAL CODE BY ADDING CHAPTER 10.23,
NO-CRUISE ZONE LOITERING.
The City Council of the City of Redding does hereby ordain as
follows:
Section 1. Title 10, Public Peace, Morals, and Welfare, of the
Redding Municipal Code is hereby amended by adding Chapter 10. 23,
No-Cruise Zone Loitering, as follows:
Chapter 10.23
NO-CRUISE ZONE LOITERING
Sections:
10. 23 . 010 Loitering in a No-Cruise Zone Prohibited
10 . 23 . 020 Definitions
10 . 23 . 030 Violations
10 . 23 . 040 Severability.
10.23.010 Loitering in a No-Cruise Zone Prohibited.
It shall be unlawful to loiter on any property in the proximity
of any posted No-Cruise Zone between the hours of 6: 00 p.m. of one
day and 6: 00 a.m. the next day.
10.23.020 Definitions.
Whenever in this chapter the words or phrases defined in this
section are used, they shall have the respective meanings assigned
to them in the following definitions:
A. "Loiter" means to delay or linger without a lawful purpose for
being on the property.

B. "Property in the proximity of any posted No-Cruising Zone"
means any property which is both visible from and located
within 300 feet of any portion of a street, alley, or highway
which is posted as a No-Cruising Zone pursuant to Chapter 11. 23
of this Code.
10.23.030 Violations.
A. Violation of this chapter is an infraction. The minimum
penalties are as follows:
1 . First conviction of loitering: $100 fine.
2. Second conviction within one year: $200 fine.
3 . Third or subsequent conviction
within one year: $250 fine.
B. The refusal of any person to leave the premises after having
been cited by any peace officer for a violation of this chapter
shall constitute a misdemeanor. The punishment for a
misdemeanor violation of this chapter shall be as provided by
Section 1. 12 . 020 A. of this Code.
C. Any minor who is cited for violation of this chapter shall be
considered in violation of a traffic offense for purposes of
California Welfare and Institutions Code Section 256.
10.23.040 Severability.
If any provision, clause, sentence, or paragraph of this
chapter, or the application thereof to any person or circumstance,
shall be held invalid, such invalidity shall not affect the other
provisions or applications of the provisions of this chapter which
can be given effect without the invalid provisions or application,
and, to this end, the provisions of this chapter are hereby
declared to be severable.
Section 2. City Council has found that this matter is
categorically exempt under Section 15321 of the California
Environmental Quality Act Guidelines.
Section 3. The City Clerk shall certify to the adoption of
this Ordinance and cause its publication according to law.
I HEREBY CERTIFY that the foregoing Ordinance adding Chapter
10. 23, No-Cruise Zone Loitering, to the Redding Municipal Code was

introduced and .read at a regular meeting of the City Council on the
6th day of April 1993 , and was duly read and adopted on the
20th day of April 1993 , at a regular meeting of the City
Council by the following vote:
