AN UNCODIFIED ORDINANCE OF THE CITY OF REDDING
APPROVING THE AMENDED AND RESTATED PARK
DEVELOPMENT AND PARK FACILITIES IMPACT FEE CREDIT
AGREEMENT BETWEEN THE CITY OF REDDING AND S & J
DEVELOPMENT AND SIERRA PACIFIC LAND & TIMBER COMPANY
FOR THE CONSTRUCTION OF SHASTINA RANCH NEIGHBORHOOD
PARK
THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:
SECTION 1. Government Code Section 65867.5(a) states that a "development agreement is a
legislative act that shall be approved by ordinance and is subject to referendum."
SECTION 2. Government Code Section 65867.5(b) states that a "development agreement shall
not be approved unless the legislative body finds that the provisions of the agreement are
consistent with the general plan and any applicable specific plan."
SECTION 3. On July 19, 2005, the City Council adopted Ordinance No. 2349, which approved
a Development Agreement entitled as the "Shastina Ranch Development Agreement" and was
pertinent to the Shastina Ranch Tentative Subdivision Map 5-7-03 and Planned Development
PD-5-04. The Development Agreement was recorded on August 30, 2005, in the Official
Records of the County of Shasta under"Instrument No. 2005-0051212."
SECTION 4. The Development Agreement approved by Ordinance No. 2349 included a "Park
Development and Park Facilities Impact Fee Credit Agreement" which was appended to the
Development Agreement.
SECTION 5. On August 16, 2011, the City Council adopted Ordinance No. 2478, which
amended and extended the Development Agreement.
SECTION 6. The City Council hereby approves the park development and park facilities
impact fee credit agreement titled Amended and Restated Park Development and Park Facilities
Impact Fee Credit Agreement, on file with the City Clerk's Office subject to such minor and
clarifying changes consistent with terms therefore as may be approved by the City Attorney prior
to execution thereof("Development Agreement").
SECTION 7. The "Amended and Restated Park Development and Park Facilities Impact Fee
Credit Agreement" shall replace in its entirety any prior impact fee credit agreement related to
parks and/or recreational facilities adopted as an exhibit to the Development Agreement adopted
by Ordinance No. 2349, and any amendment to the same.
SECTION 8. The City Council adopts the following findings in conjunction with its approval of
the Development Agreement:
(a) Public hearings have been held by the Planning Commission and the City Council as
required by California Government Code Section 65867, et seq.; and Redding Municipal
Code Section 18.20.030.
(b) Notice of public hearings in the form of a notice of intention to consider approval of a
development agreement has been given in compliance with State law, California
Government Code Section 65867 and Redding Municipal Code Section 18.20.030.
(c) The Development Agreement is consistent with objectives, policies, general land uses,
and programs specified in the City's General Plan and all applicable specific plans.
(d) The Development Agreement as amended is in the best interest of the City.
(e) The Development Agreement promotes the public interest and welfare of the City.
(� The Development Agreement as amended is consistent with and conforms to the
requirements of California Government Code Sections 65864-65869.5.
(g) The Development Agreement is within the scope of the project defined in Environmental
Impact Report EIR-1-03.
SECTION 9. The Mayor is authorized and directed to execute the Development Agreement on
behalf of the City of Redding.
SECTION 10. This ordinance shall take effect thirty (30) days after the date of its adoption, and
the City Clerk shall certify to the adoption thereof and cause publication according to law.

meeting of the City Council of the City of Redding on the 16th day of February, 2021, and was
duly read and adopted at a regular meeting of the City Council on the 2nd day of March, 2021,
