Code§6103 A.P.N. 050-800-025 RESOLUTION NO.2021-033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING THE CITY'S INTEREST IN THE SOUTHERLY 5 FEET OF A STORM DRAIN EASEMENT ACROSS LOT 25 OF CROWN MEADOW ESTATES,UNIT 2 S-02-05,FILED ON MARCH 12,2007 IN BOOK 24 OF MAPS, PAGE 29, SHASTA COUNTY RECORDS (ABANDONMENT APPLICATION A-2020-08370) WHEREAS: A. The 5 foot wide portion of an existing 15 foot wide Storm Drain Easement being considered for summary vacation was acquired by the recordation of Crown Meadow Estates Unit 2 Highland Oaks Subdivision, Unit 2 S-02-05, filed on March 12, 2007 in Book 24 of Maps, Page 29, Shasta County records and is described in Exhibit "A" and shown on Exhibit "B" attached and made a part hereof by reference. B. There are no public facilities within the southerly 5 feet of the Strom Drain Easement and therefore may be determined to be excess and eligible for summary vacation. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the southerly 5 feet of the Storm Drain Easement as described in Exhibit"A"and shown hatched on Exhibit"B." 3. This portion of easement being vacated is considered excess; therefore, from and after the date G this Resolution is recorded, the Storm Drain Easement described in Exhibit "A" and shown on 5 Exhibit "B," shall be vacated in its entirety and longer constitutes an easement for public purposes. G 4. The vacation of southerly 5 feet of Storm Drain Easement is consistent with the General Plan and qualifies as Categorically Exempt from environment review under the California Environmental Quality Act Guidelines Section 15312 and 15061. The easement was acquired by dedication to the City for storm drain purposes. There are no environmental attributes to the property underlying the storm drain easement which would merit preparation of a mitigated negative declaration or environmental impact report. The underlying property does not have significant values for wildlife habitat or other environmental purposes and is of such size and shape that is incapable of independent development or use. The property underlying the storm drain easement has not changed since the time of its acquisition by the City. As such, there is no possibility that vacation of the storm drain easement will have a significant impact on the environment. 5. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the Clerk under seal,to be recorded in the Office of the Shasta County Assessor/Recorder.
