RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE SALE
OF SURPLUS PROPERTY LOCATED AT 2958 VICTOR AVENUE TO TRIOND A CALIFORNIA
GENERAL PARTNERSHIP, AND AUTHORIZING THE MAYOR TO ENTER INTO A PURCHASE/
DEVELOPMENT AGREEMENT BETWEEN THE CITY OF REDDING AND TRIOND
WHEREAS, the City owns surplus property located at 2958 Victor Avenue described as a portion of Assessor's
Parcel No. 67-370-28; and
WHEREAS,said property is adjacent to property owned by Triond identified as Assessor's Parcel Nos.67-370-
49 and 67-370-19; and
WHEREAS, Triond wishes to expand its existing Food and Liquor Store at the Northwest corner of Victor
Avenue and Hartnell Avenue; and
WHEREAS, Triond wishes to purchase said City property to effect said expansion; and
WHEREAS, it is deemed to be in the best interests of the City of Redding to sell said property to Triond;
NOW, THEREFORE, BE IT RESOLVED that:
1. The City Council of the City of Redding hereby approves the Agreement between the City of Redding and
Triond, a California General Partnership.
2. The Mayor is hereby authorized and directed to sign the Agreement; and
3. A true copy of the Agreement referred to herein is attached hereto and made a part hereof.
I HEREBY CERTIFY that the foregoing resolution was introduced and read at a regular meeting of the City
Council of the City of Redding on the 17th day of Decenioer 1991, and was duly adopted at said meeting
by the following vote:

PURCHASE/DEVELOPMENT AGREEMENT BETWEEN THE CITY OF REDDING
AND TRIOND, PERTAINING TO THE PURCHASE AND DEVELOPMENT OF
SURPLUS VICTOR AVENUE PROPERTY
This Agreement is made and entered into this day of December,
1991, by and between the City of Redding ("City") and Triond, a California General
Partnership ("Triond") .
RECITALS
WHEREAS, the City owns surplus property located at 2958 Victor Avenue
described as a portion of Assessor's Parcel No. 67-370-28 and further identified on
Exhibits "A" and "B" attached hereto; and
WHEREAS, said property is adjacent to property owned by Triond identified
as Assessor's Parcel Nos. 67-370-49 and 67-370-19; and
WHEREAS, Triond wishes to expand its existing Food and Liquor Store at the
Northwest corner of Victor Avenue and Hartnell Avenue; and
WHEREAS, Triond wishes to purchase said City property to effect said
expansion; and
WHEREAS, Triond has applied for an Amendment to the General Plan to change
the Land Use Classification of Assessor's Parcel Number 67-370-19, located at 2963
Roberts Court, from "Residential, 4.0 and 12.0 units per acre" to "Retail"; and
WHEREAS, the General Plan Amendment was expanded to include said City
property and said property was reclassified from "Residential, 4.0 per acre" to
"Retail"; and
WHEREAS, City wishes to insure that both City and Triond property are
developed as intended.
NOW THEREFORE, it is mutually agreed by City and Triond as follows:
1. City hereby agrees to sell and Triond agrees to purchase surplus property as
described in Exhibit "A" and shown on Exhibit "B" attached hereto, for the
sum of Nineteen Thousand Dollars ($19,000.00) .

2. Upon execution of this Agreement by both parties, an escrow account will be
opened at Ticor Title Company, 1647 Court Street, Redding, California, for
the purpose of transferring title of the property from City to Triond. Escrow
fees shall be shared equally by City and Triond.
3. Fee Title shall be granted by City to Triond by Grant Deed, free and clear of
all encumbrances except for a 5-foot easement to the City of Redding for
public-service purposes running along the east boundary of the subject
property.
4. Triond will comply with the conditions of approval of Use Permit UP-93-91
when approved by the City.
5. Triond will insure that all improvements identified in this Agreement shall be
in place within one year of the effective date of UP-93-91. Failure to meet this
condition will result in the reversion of the ownership of the property to the
City of Redding. If this reversion should occur, the sum of Eighteen
Thousand Dollars ($18,000) will be returned to Triond and the sum of One
Thousand Dollars ($1,000) will be retained by City for handling fees.
IN WITNESS WHEREOF, the City and Triond have executed this Agreement as
of the date first above written.

LEGAL DESCRIPTION
All that real property situated in the City of Redding, County of
Shasta, California, being the westerly portion of Lot 1 of Block 2, as
shown on the map of Royal Oaks Subdivision Unit No. 1, filed in Book
9 of Maps at page 10, Shasta County Records, more particularly
described as follows:
Beginning at the southwest corner of said Lot 1;
Thence S-89-17-44-E, 67.28 feet
Thence N-06-57-33-W, 67.42 feet
Thence N-89-17-44-W, 58.39 feet
Thence S-00-37-17-W, 66.82 feet
to the point of beginning containing 4,198 square feet.
RESERVING THEREFROM, a 5-foot easement for Public Service
purposes along the easterly boundary.
