A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE TERMS OF THE SETTLEMENT AGREEMENT BETWEEN
THE NORTHERN CALIFORNIA POWER AGENCY AND PACIFIC GAS
AND ELECTRIC, AS SETTLEMENT OF THE E-7777 CASE FOR THE
CITY OF REDDING.
WHEREAS, the Federal Energy Regulatory Commission (FERC)
ordered settlement negotiations between the Northern California
Power Agency (NCPA) and Pacific Gas and Electric (PGandE) , to end
all disputes between NCPA and PGandE; and
WHEREAS, one of the disputes, known as E-7777, was
originally filed with FERC by the public utilities in California
to protest the anti-competitive actions of the investor-owned
utilities, and has been in litigation for approximately 20 years;
and
WHEREAS, as a member of NCPA, Redding' s interests in the
E-7777 case have been represented by NCPA; and
WHEREAS, because of the inclusion of the E-7777 case in the
NCPA/PGandE Settlement Agreement, Redding must approve the
Agreement, along with the members of NCPA that are parties to the
NCPA Interconnection Agreement, or be left as the only litigant
remaining in the E-7777 case, with the option to either fund the
litigation effort on our own or drop the case with no settlement;
and
WHEREAS, Redding' s approval of the Settlement Agreement does
not obligate Redding to the terms of said Agreement; however, the
Agreement includes a provision that enables Redding to either t
become a signatory to the new NCPA/PGandE Interconnection Agree-

ment or receive benefits similar to those afforded the other NCPA
members in a subsequent agreement between PGandE and Redding; and
WHEREAS, inasmuch as Redding is currently discussing a new
agreement with PGandE, the options afforded Redding by the
NCPA/PGandE Settlement Agreement will be useful in City/PGandE
negotiations; and
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council
of the City of Redding hereby approves the terms of the
Settlement Agreement between the Northern California Power Agency
and Pacific Gas and Electric, as approved by the Redding City
Attorney, in settlement of the E-7777 case for the City of
Redding.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 17th day of December , 1991 , and was
duly adopted at said meeting by the following vote:
