HomeMy WebLinkAboutReso 91-481 - Approve & Authorize teh mayor to execute the MOU between COR, City of Anderson, The County of Shasta, and Calif Dept of Commerce pertaining to Shasta Metro Enterprise Zone Designation RESOLUTION NO. /- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF REDDING, THE CITY OF ANDERSON, THE COUNTY OF SHASTA, AND THE CALIFORNIA DEPARTMENT OF COMMERCE PERTAINING TO THE SHASTA METRO E TERPRISE ZONE DESIGNATION. WHEREAS, on August 21, 1990, by Resolution No. 90-421, City Council endorsed the joint application of the Cities of Redding and Anderson and the County of Shasta for the designation of an Enterprise Zone in Shasta County; and WHEREAS, the Cities of Redding and Anderson and the County of Shasta have proposed the designation of Shasta Metro Enterprise. Zone. pursuant to Section 7073 of the California Government Code, for the purpose of stimulating and maintaining employment and investment in this economically depressed area; and WHEREAS, the California Department of Commerce has reviewed the Enterprise Zone designation, and has granted a conditional approval therefor; and WHEREAS, presented herewith for Council' s consideration is a Memorandum of Understanding to be entered into between the City of Redding, the City of Anderson, the County of Shasta, and the California Department of Commerce for the purpose of assuring their mutual and common understanding of the intent of each party to use their best efforts, subject to availability of financing, to continue and complete long-term projects and programs to attract private sector investment and employment to the Shasta Metro Enterprise Zone; NOW, THEREFORE, IT IS HEREBY RESOLVED that the above recitals are true and correct, and that the City Council of the City of Redding hereby approves the above-referenced Memorandum of Under- a standing, a true copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Memorandum of Understanding on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. HAYS, ity Attorney 2 MEMORANDUM OF UNDERSTANDING BETWEEN THE CITIES OF REDDING AND ANDERSON, THE COUNTY OF SHASTA AND THE CALIFORNIA DEPARTMENT OF COMMERCE LEGAL AUTHORITY The Cities of Redding and Anderson and the County of Shasta have proposed the designation of the Shasta Metro Enterprise Zone, generally indicated on the map attached to and made a part of this agreement, pursuant to Section 7073 of the California Government Code with the purpose of stimulating and maintaining employment and investment in this economically depressed area. The California Department of Commerce has reviewed the Enterprise Zone designation pursuant to California Government Code Section 7073 and the Application Guidelines, and has granted a conditional approval of this designation. BACKGROUND The Enterprise Zone Program provides for the designation of 25 areas of California for a fifteen year period. The State of California has agreed to provide certain incentives to businesses located within these areas as specified in Sections 17052. 13 , 170538. 8 , 17053 . 9 , 17231, 17252. 5 , 23612 , 24331, 24333 , 24356. 2, 24384, and 24417 of the California Revenue and Taxation Code with the purpose of stimulating new investment and employment in said areas. The California Department of Commerce awarded conditional designation to the Shasta Metro Enterprise Zone based upon the application to the Department which committed the Cities of Redding and Anderson, and the County of Shasta to encourage and facilitate job maintenance and business and job development in the proposed Enterprise Zone through a series of local incentives, projects and programs. The Department of Commerce has notified the Cities of Redding and Anderson, and the County of Shasta of its conditional designation, specified the conditions which must be met prior to the award of final designation, and set a deadline of January 20 , 1992 , for those conditions to be met. Certain conditions specified by the Department of Commerce, based on the Shasta Metro Enterprise Zone application to the Department, pertain to incentives, programs and projects which, by their nature, are long term efforts on the part of the Cities of Redding and Anderson, and the County of Shasta to revitalize the designated Enterprise Zone. Memorandum of Understanding Between the Cities of Redding and Anderson, the County of Shasta and the California Department of Commerce Page 2 STATEMENT OF PURPOSE The California Department of Commerce and the Cities of Redding and Anderson, and the County of Shasta enter into this agreement for the purpose of assuring their mutual and common understanding of the intent of each party to use their best efforts, subject to the availability of financing, to continue and complete long term projects and programs to attract private sector investment and employment to the Shasta Metro Enterprise Zone. OBJECTIVES It is mutually agreed that: 1. The Cities of Redding and Anderson, and the County of Shasta will provide marketing and promotional efforts to existing businesses as well as business attraction. 2. The Cities of Redding and Anderson, and the County of Shasta will provide the necessary staff and funding to implement all programs and plans identified in the final application. 3 . The Cities of Redding and Anderson, and the County of Shasta assures the necessary infrastructure development for a 15-year build-out of the Enterprise Zone. 4. This Memorandum may be amended by the mutual agreement of all parties. 5 . This Memorandum and any amendments thereof, shall remain in effect until terminated by the Director of the Department of Commerce, or until such time as the state designation of the Shasta Metro Enterprise Zone is no longer in force or effect. IN WITNESS WHEREOF, the parties agree to have executed this Memorandum on this day of , 1991. The Memorandum shall become effective upon the execution of it by all parties.
